Alec Baldwin 'Rust' Trial: Actor Heads to Court for Preliminary Hearing

SANTA FE, New Mexico Alec Baldwin strolled into a New Mexico courthouse Monday morning ahead of his involuntary manslaughter trial for the accidental killing of cinematographer Halyna Hutchins.

The “30 Rock” star stepped out of a black Chevrolet Suburban with his entourage. Baldwin arrived in court despite not being able to appear for a preliminary hearing in First Judicial District Court in Santa Fe.

The actor, who was accompanied by his lawyer Alex Spiro, wore a dark suit, tie and black-rimmed glasses. He did not address the crowd of reporters outside.

A gun Baldwin was holding went off on the set of the 2021 Western film “Rust,” killing Hutchins and wounding director Joel Souza. He has pleaded not guilty.

If convicted, he faces up to 18 months in prison. Jury selection is scheduled to begin Tuesday. Baldwin said he cocked the gun but did not pull the trigger.

After entering the courthouse, he sat at the defense table flanked by Spiro and defense attorney Luke Nikas and scribbled notes on a yellow legal pad.

The actor was spotted at the luxurious Eldorado Hotel and Spa on Sunday evening, meeting with more than a dozen members of his legal team in a large conference room.

It is not known whether he is staying at the hotel, but it has a sumptuous presidential suite.

Judge Mary Marlowe Sommer will hear arguments Monday on a series of motions that will determine what evidence can be presented at trial.

Baldwin's lawyers want to ban any discussion of the accidental shooting death of actor Brandon Lee on the set of the 1993 film “The Crow.”

Bruce Lee's son was shot by a fake gun, and the tragic death ushered in strict gun safety protocols on Hollywood film sets.

Prosecutors also want to exclude findings from an OSHA report that found Deputy Director Dave Halls primarily responsible for Hutchins' killing. Halls has pleaded not guilty to negligent use of a firearm and could testify for the state.

Defense attorneys say OSHA safety officer Lorenzo Montoya, who interviewed Baldwin after the shooting, should not be allowed to testify.

Prosecutors tried unsuccessfully to block the OSHA report and Montoya from testifying at the involuntary manslaughter trial of gunsmith “Rust” Hannah Gutierrez Reed.

She is serving an 18-month sentence after being convicted of the same charge Baldwin currently faces.

Jurors found she was reckless in placing a live round in the gun Baldwin was holding at the time of the shooting. Gutierrez Reed has appealed her conviction.
