Trump lawyers allege 'serious juror misconduct' in latest attack on silence conviction

President-elect Donald Trump's lawyers say they received evidence of “gross juror misconduct” in the New York criminal case that resulted in his conviction on 34 counts.

“The extensive and pervasive misconduct at issue violated President Trump's rights under the Federal Constitution and New York law,” Trump's lawyers, Todd Blanche and Emil Bove, wrote in a Dec. 3 letter that was revealed on Tuesday.

Trump's lawyers told NBC News they wrote the letter after a juror in the case contacted them. Manhattan District Attorney Alvin Bragg's office did not immediately respond to a request for comment.

Details of the alleged misconduct were unclear. The letter is heavily redacted.

In a response letter also disclosed Tuesday, the prosecutor's office called the misconduct allegations “vague” and said the person who shared the claim told Trump's team that their summary of the allegations contained inaccuracies .

In an order Monday ordering the letter made public, Judge Juan Merchan said it contained “unsworn and disputed statements” that could threaten the safety of jurors if published in full on the court's public docket .

An unredacted portion of the letter reads: “This behavior is completely unacceptable and demonstrates beyond doubt that the verdicts in this case are as unreliable as District Attorney Braggs' promise to protect Manhattan residents from violent crime.” »

The letter urged Merchan to “review” the allegations while he ruled on Trump's motions to dismiss the case, but Merchan said in his order Monday that he could not do so.

Allegations of juror misconduct must be fully investigated. However, this Court is prohibited from ruling on such allegations based on mere hearsay and conjecture,” he wrote, noting that this could change if Trump decides to overturn the verdict on grounds of juror misconduct.

“Such a motion 'must contain allegations under oath,'” Merchan wrote.

It added: “If a properly filed complaint is submitted, these deletions will be reviewed. »

The prosecutor's letter says Trump's lawyers told Merchan they did not want a hearing into the alleged misconduct and called the possibility an invasive investigation.

Merchan on Monday denied Trump's attempt to overturn his conviction for falsifying business records on the grounds of presidential immunity.

Trump criticized Merchan for the decision in a post Tuesday on his social media platform, Truth Social, calling it a “completely illegal psychotic order.”

Merchan “completely disrespected the United States Supreme Court and its historic ruling on immunity,” Trump added. “But even without immunity, this illegitimate affair is nothing more than a faked hoax.”

Trump still has a sweeping motion to dismiss the case pending before Merchan.
