Donald Trump is the first US president to be convicted as a criminal, but avoids prison and punishment

Donald Trump today became the first criminal in the White House after a US court upheld his conviction in a hush money case. He was sentenced to “unconditional discharge” for concealing unaccounted payments to porn star Stormy Daniels.

This means that the president-elect has been found guilty of his charges, but will not face any jail time or punishment because he was elected president of the United States and will take the oath of office before the highest office in the land on January 20 – a position that comes with the impunity of being above the law both in office and beyond.

So even though the 34 counts of falsifying Donald Trump's business records that he was convicted of in May 2024 carried potential prison time, there was little the judge could do about it , ending up having to spare the president-elect. If he had not been president, Donald Trump would have been sentenced to four years in prison. Instead, he will return to the White House as president for four more terms.

Donald Trump didn't even attend the hearing in person, choosing to do so virtually, knowing full well he wouldn't be sent to prison.

Stormy Daniels had testified in great detail about her alleged meeting with Trump at a hotel in Navada.

“This court has determined that the only legal penalty that allows for a judgment of conviction without encroaching on the highest office in the land is an unconditional release,” New York Judge Juan Merchan declared in pronouncing the sentence.

The judge added: “Never before has this court been confronted with such a unique and remarkable set of circumstances.” With the Constitution protecting the highest office in the United States, the judge had no choice but to give the former president an “unconditional discharge.” Any other ruling would risk encroaching on the presidential immunity granted to the highest office in the country.

Even before the conviction, to avoid the dubious distinction of being the first criminal to ever be in the White House, Donald Trump used all his power and resources to make a last-ditch effort to avoid it.

Hours before the sentencing, Donald Trump said he believed the entire legal proceeding was actually a “setback for the New York justice system.” “This was done to damage my reputation, just so I could lose the election,” he claimed, adding that it had been a “terrible experience” for him.
