Democratic attorneys general file lawsuit to block Trump's attempt to end birthright citizenship

Democratic attorneys general filed lawsuits in Massachusetts and Washington state on Tuesday to try to block President Donald Trump's attempt to revoke the right to automatic birthright citizenship.

Trump signed an executive order Monday to limit birthrights to people with at least one parent who is a U.S. citizen or permanent resident.

The proposal faces an uphill battle and strong opposition from not only the 23 Democratic attorneys general, but also civil rights groups, which have already filed their own lawsuit.

“This is a war on American families led by a president who has absolutely no respect for our Constitution. We have filed suit and I am confident we will win,” said Connecticut Attorney General William Tong.

He and 18 other attorneys general filed the lawsuit in federal court in Massachusetts. Four states, Washington, Arizona, Oregon and Illinois, filed the other suit.

It has long been accepted that the 14th Amendment to the Constitution guarantees the right to birthright citizenship to everyone born in the United States, except the children of diplomats.

All persons born or naturalized in the United States and subject to its jurisdiction are citizens of the United States, the amendment states.

Trump's proposal won't take effect for another month, giving the courts plenty of time to block it before then.

Both lawsuits were filed in districts under the jurisdiction of appeals courts, with a majority of judges appointed by Democrats.

The Supreme Court ruled in 1898, in a case called United States v. Wong Kim Ark, that a man born in San Francisco to parents who were both Chinese was an American citizen.

Many legal experts say the court, despite a 6-3 conservative majority, including three Trump-appointed justices, would likely reject the administration's new interpretation of the law.
