The Supreme Court orders the government and Tepco to pay compensation for the Fukushima crisis

On Wednesday, the Sendai High Court ordered the state and operator of the defective Fukushima nuclear plant to pay 1 billion yen ($ 9.5 million) in compensation to residents for the 2011 tsunami.

It was the first time that a supreme court had recognized state responsibility for the accident in nearly 30 similar lawsuits filed across Japan.

The amount that the Sendai Court asked the government and Tokyo Electric Power Holdings Inc. to pay to 3,550 claimants was higher than the 500 million yen that a lower court ordered them to pay about 2,900 claimants in a ruling issued in October 2017.

Chief Cabinet Secretary Katsunobu Kato told a news conference that the government would review the ruling before deciding how to respond to it.

In line with the 2017 ruling by the Fukushima District Court, the Supreme Court made its decision based on three disputed points, including whether a major tsunami could be expected.

The other two points are whether countermeasures can be implemented to prevent a disaster, and whether the compensation levels set by the government are adequate.

The plaintiffs sought to pay a monthly compensation of about 50,000 yen per person so that the radiation in their homes would return to the pre-crisis level, bringing the total final demand to about 28 billion yen.

Meanwhile, the state has argued that it is impossible to predict the tsunami and prevent the subsequent disaster. Tepco claimed it had already paid compensation according to government guidelines.

In the district court ruling, the government and Tepco were blamed for failing to take steps to counter the massive tsunami caused by the earthquake.

It ruled that the two should have been able to forecast altitude hazards of up to a maximum of 15.7 meters, based on an earthquake assessment issued in 2002, and that the disaster could have been prevented if the state had instructed the operator to implement the measures that year.

A magnitude 9.0 earthquake and subsequent tsunami struck northeastern Japan on March 11, 2011, causing multiple collapses and hydrogen explosions at the nuclear power plant.

About 55,000 people remained in and outside Fukushima Prefecture as of the end of August.
