NEW DELHI: The CBI has approached the United States under the Mutual Legal Assistance Treaty to collect metadata and content data from the email id of a “Formless Yogi” believed to be the NSE manager Anand Subramanian under investigation in the stock exchange roommate scam case, officials said here on Friday.

The central agency needs data from Microsoft for the email id [email protected] which was allegedly used by Subramanian to communicate with NSE Managing Director and CEO Chitra Ramkrishna, both under investigation in the case. roommate scam, they said.

Under the Mutual Legal Assistance Treaty (MLAT), which was ratified by India in 2005, the two countries assist each other in criminal law cases with the sanction of their respective central authorities – the Ministry of Interior in the case of India and the Attorney General in the case of India. case of the United States.

The CBI, through the Department of the Interior, sent the request to the United States to provide metadata and content data from Microsoft Inc’s user ID [email protected] to support evidence of the agency against Ramkrishna and Subramanian in the case.

In its recently filed indictment, the CBI said its investigation into NSE’s unauthorized data leak showed that Ramkrishna, then NSE’s Managing Director and CEO, communicated with an external email ID “[email protected] com” via their email credentials.

The CBI, in its indictment against Subramanian and Ramkrishna, alleged that in his disclosure statement under Section 27 of the Indian Evidence Act, Subramanian admitted to exploiting said email id “[email protected] .com”.

He even accessed said email address in the presence of independent witnesses from whom offending emails were recovered, they said.

The CBI alleged that Subramanian created the email id on March 10, 2013 to communicate with him to further their criminal plot.

Subramanian’s controversial appointment and subsequent elevation, in addition to crucial decisions, were guided by an unidentified person who Ramkrishna said was a mysterious formless yogi living in the Himalayas, an investigation into his email exchanges during of the audit ordered by Sebi.

In his statement to Sebi, Ramkrishna had said that the unknown person with email id [email protected] was a ‘Sidha-purusha’ or ‘paramhansa’ who had no physical personality and could materialize at will. .

The CBI has completed the investigation into alleged violations of Ramkrishna’s appointment of Subramanian to exorbitant salary without NRC approval.

An indictment has been filed against the duo under the criminal association and criminal misconduct sections of the ICC under the Prevention of Corruption Act.

“It has been alleged that the owner and developer of said private company misused NSE’s server architecture in a conspiracy with unknown NSE officials.”

“It has also been alleged that unknown officials of NSE, Mumbai provided unfair access to the said company using the co-location facility during the period 2010-2012 resulting in it being logged in first to the Exchange’s exchange server which helped obtain the data before any other broker in the market,” the CBI alleged in the FIR.
