California Voters Approve Creation of New State Agency to Enforce CCPA | Item

With a total of 56% in favor versus 44% against, California voters approved Proposition 24, according to figures released by the California Secretary of State. The measure passes a new law, the California Privacy Rights Act (CPRA).

The CAPL will prohibit companies from sharing sensitive information about customer health, finances, race, ethnicity and specific location; triple fine for violations of children’s data; and impose new limits on how businesses can collect, share and sell customer personal data. The law will also close a loophole concerning the sale of data; all data shared or sold will be covered by ACPL. On several of these fronts, data privacy experts say the ACPL is better aligned with the GDPR than the CCPA currently does.

The ACPL will eventually replace the CCPA in January 2023. Until then, the CCPA will continue to be in effect.

What will soon change, from the second quarter of 2021, is the agency responsible for enforcing the CCPA. Proposition 24 removes CCPA regulation and enforcement from the California Attorney General and assigns these functions to a new independent entity, the California Privacy Protection Agency.

The California state budget for fiscal 2021 contains about $ 10 million per year to fund the new agency, which will allow it to hire between 46 and 50 employees. Its only mission will be the development of rules and the application of the CCPA and, possibly, of the CPRA. The earliest the agency could tap the funding is July 1, 2021, the start of the California fiscal year.

Think about it for a minute. This agency’s sole purpose in life will be to protect the privacy of Californians, said Dan Clarke, president of IntraEdge, an Arizona-based software company that helps businesses comply with data privacy regulations such as as the CCPA and the EU General Data Protection Regulation (GDPR). I think they will be aggressive.

Californians for Consumer Privacy, proponents of Prop 24, said the new law would give Californians the world’s strongest online privacy rights, including protecting sensitive personal information, tripling fines against companies that violate children’s data, establishing an enforcement arm for consumers, and it will be more difficult to weaken privacy laws in the future, the group said in a report. press release published on Wednesday.

In the same press release, Prop 24 sponsor and real estate developer Alastair Mactaggart called the vote historic and said its passage would profoundly shape the fabric of our society by redefining who controls our most personal information and handing consumers over to it. in charge of their own data.

Former Democratic presidential candidate and chairman of the group’s advisory board, Andrew Yang, predicted that the new-era privacy rights established by Prop 24 would sweep the country.

Opponents of Prop 24 criticized the new agency for being toothless and said the privacy law would cost California consumers and small businesses billions, opposition groups say. Website.

But Omer Tene, vice president and chief knowledge officer of the International Association of Privacy Professionals, predicted the new agency would pave the way for privacy enforcement alongside the Federal Trade Commission at the federal level. Most importantly, it will catalyze the emergence of additional privacy legislation, first in states such as Washington, New York and Texas, and ultimately in the US Congress.

The attorneys general’s office began enforcing the CCPA on July 1, but has yet to file a CCPA-related action against a company. The Office of the Auditor General has sent notices to companies suspected of not complying with the CCPA and given them time to correct the deficiencies before taking legal action.

How the ACPL builds on the ACCP

CCPA requires companies to inform California consumers about the personal information they collect. The law gives consumers the right to delete their data from a company’s database and the right to refuse that a company collect their personal information.

The ACPL assigns additional responsibilities to companies as to how they should handle this private data, such as prohibiting companies from sharing sensitive information about customer health, finances, race, ethnicity and location. specific; triple the fines for violations of children’s data; and by placing new limits on how businesses can collect, share and sell customer personal data. On several of these fronts, data privacy experts say the ACPL is better aligned with the GDPR than the CCPA currently does.

Stephen Cavey, co-founder of Ground Labs, a vendor that develops data management and regulatory compliance technology, says the MGA office has done a lackluster job teaching companies what they should do to comply with the CCPA and is happy with the responsibility of the application and explain that the law is passed on to another agency.

They haven’t really informed California businesses what to do, Cavey said of the AG office. Other than four public briefings and two videos on its website, the Auditor General’s office has done little to explain the law to businesses, he said.

This is not how you should put the best US privacy laws in place, he said. They could have done so much better.

In the information vacuum, salespeople selling products and law firms selling advice, Cavey said.

As it stands, the AG’s office assumes everyone is compliant until they are hacked and they lose clients’ personal data, Cavey said. The government’s response would then be to fine the company and the aggrieved consumers could bring a class action lawsuit, which is permitted under the LCCP.

There really aren’t any winners in this scenario, Cavey said. Rather, it should be about promoting good privacy practices, not fining a company and issuing a press release about it.

Cavey says even the smallest businesses can take steps to strengthen their defenses against hacking, loss of sensitive customer data, and potentially a fine under the CCPA.

It recommends that businesses enable the built-in security features on their phones and online platforms. The simplest feature is two-factor authentication, which requires users to log in with a password and verify their identification in some other way, for example with a fingerprint, scan biometric, access code or other means.

Then install a password manager app on your phone, many of which are free. The Password Manager will keep your different passwords organized, allowing you to make sure the passwords are very different for each password protected use.

Finally, get to know your business data. This does not necessarily imply the hiring of a consultant. It means understanding the nature of the personal data your business collects, where and how that data is stored and why it is collected. Are there data on children? Can you remove it without compromising other business functions? Do you really need to collect birthdates and mother’s maiden name from your customers, or are there other ways to authenticate them without collecting, storing and potentially losing this personal information?

Answering these questions will put your business on the path to CCPA and eventually CPRA compliance.
