Man who attacked Filipino family at North Hollywood drive-thru arrested and charged with hate crimes
The man who allegedly harassed and attacked a Filipino family at a McDonalds drive-thru in North Hollywood last month has been arrested and charged with hate crime enhancement.
Nicholas Weber, 31, was arrested in Orange County around 7:40 p.m. on June 16, Costa Mesa Police Department spokesman Roxi Fyad said in a report. Authorities reportedly received a call about a man who may have passed out on the sidewalk and later identified him as Weber.
On Wednesday, authorities announced that Weber was back in custody in Los Angeles.
Weber, who was arrested on an outstanding felony assault warrant from the Los Angeles Police Department, faces charges of aggravated assault causing grievous bodily harm and misdemeanor assault, both with hate crime enhancements, according to court records. He is to be arraigned on Thursday.

Although it will take time for the Roque family and the community to heal, Webers’ arrest is a step toward putting in place judges for the Roques, said Sandy Roxas, the Roque family’s attorney.
Weber has been held accountable for a long time, and we hope this sends a message not only to victims of Asian hate crimes, but also to those who incite violence against our community, Roxas added. Pressuring law enforcement is essential to fighting for justice, and I thank them for finally apprehending Weber.

Weber was filmed harass and assault a filipino family on May 13, by ordering from a McDonalds drive-thru on Victory Boulevard in North Hollywood.
The verbal altercation turned physical when Weber allegedly assaulted Gabriel Roque, who arrived on the scene minutes after being called out by Patricia. The 60-year-old father suffered a broken rib in the attack and Nerissa was reportedly choked trying to stop Weber.
Authorities arrested Weber but released him the same evening as the incident. A warrant of arrest was issued when he did not appear in court June 8.

Activists gathered behind the Roque family outside the Van Nuys district attorneys office on June 17, demand justice for the family and calling on officials to investigate and prosecute Weber for committing a hate crime.
