Stripper sues Florida over new age restrictions for adult entertainment business employees

TALLAHASSEE, Fla. — A 19-year-old girl and the club where she worked as a stripper have sued the Florida attorney general and two local prosecutors to block enforcement of a new state law that prohibits adult entertainment businesses from employing people under 21, saying it violates their constitutional rights.

Serenity Michelle Bushey claims in her lawsuit that she lost her job at Café Risque in the Gainesville area after the law went into effect Monday because she is under 21. The law was intended to deter human trafficking, according to Florida lawmakers.

The lawsuit, filed Monday in federal court in Tallahassee on behalf of Bushey, who owns Café Risque and two adult businesses in Jacksonville, seeks a permanent injunction preventing enforcement of the law, saying it violates their First Amendment right to free speech and their Fourteenth Amendment right to equal protection.

In addition to Bushey, eight other adult performers over the age of 18 but under the age of 21 are prohibited from working at Café Risque because of the new law, the lawsuit says.

Like other similar performers across the state, Bushey earned his living from his art while providing entertainment for the benefit and enjoyment of his audience, the complaint alleges. The plaintiffs clearly have a legal right to engage in protected speech of this nature.

The new law also prohibits hiring cooks, DJs, waitresses and security guards over the age of 18 but under the age of 21, or even using workers in that age range from third-party contractors hired to perform tasks such as air conditioning repair or carpentry, the lawsuit says.

Kylie Mason, communications director for the attorney general's office, said Tuesday that the office had not yet been served with the complaint but would defend the new law.
