West Hollywood bars now offer drug testing kits for sale under new California law
Starting July 1, 2024, West Hollywood bars like Revolver, Trunks and Mother Lode are required to offer drug screening kits to sell to their customers under Assembly Bill 1013, introduced by MP Josh Lowenthal. The new law applies to establishments with a Type 48 license. The new requirement does not impact establishments that serve food with Type 47 licenses such as The Abbey WeHo, Micky's WeHo, Rocco's WeHo and Beaches WeHo.
The Alcoholic Beverage Control Act, overseen by the Department of Alcoholic Beverage Control, governs the application, issuance, suspension, and conditions of various licenses to sell alcoholic beverages. A violation of the act is generally considered a misdemeanor. However, AB 1013 specifically states that violations of its provisions will not be treated as criminal offenses.
This law requires new applicants and current Type 48 license holders to sell drug testing devices at a reasonable price based on wholesale prices. Licensees must also post a notice in a conspicuous place stating: Don't Do Drugs! Drug testing kits containing drugs are available here. Ask a staff member for details.
The bill exempts licensees from liability for faulty or inaccurate test results, including false positives or negatives. Additionally, licensees must ensure that devices are within their expiration dates and recommended use periods.
The Department of Alcoholic Beverage Control will provide information about these requirements on its website, including details about required signage and the types of testing devices required. The provisions of AB 1013 will remain in effect until January 1, 2027.
