Framingham Board of Trustees Suspends Licenses of Cafe Belo Operating as Nightclub
FRAMINGHAM city officials voted Monday to temporarily suspend a Brazilian barbecue restaurant's liquor license and temporarily suspend its entertainment license after the restaurant was accused of operating as a nightclub.
The Board of Licensing Commissioners voted to suspend Belo's Cafe The city council decided to suspend the restaurant's liquor license for three consecutive days within 30 days of the decision, which was made at Monday's meeting.
However, during the meeting, board members also raised questions about the type of entertainment held at Cafe Belo, leading board members to vote 3-2 to suspend the restaurant's entertainment license for 14 days, pending a decision by Mayor Charlie Sisitsky on the question of whether to suspend the license on Sundays.

Commissioner Alycia DeAngelis was the lone vote against suspending the liquor license, pointing to evidence of nightclub activity on social media.

Cafe Belo, which opened in early 2023, is located at 2 Beacon St., a location where previous establishments had multiple alcohol violations, including Angry Ham's Garage and Beacon Street Bar & Grill, the former of which was featured on the reality TV show “Bar Rescue” in 2011.
Police object to restaurant staying open until 2 a.m.
Concerns were previously raised when Café Belo applied for a fully alcoholic restaurant licence and a regular victuals licence in June 2022.
In a letter to the licensing board at the time, Lieutenant Thomas McCarthythe commander of the licensing office for the Framingham Police Departmentsaid a 2 a.m. closing would pose a public safety risk because Framingham has few public transportation and taxi options for those who cannot drive after drinking at the establishment; furthermore, he wrote, the pedestrian fatality rate also makes walking home not a safe option.
McCarthy told the board at Monday night's meeting that Louis Costa, manager and owner of Cafe Belo, was cooperating with the investigation.
Additionally, Costa said he has already begun making changes to ensure overcrowding does not happen again. Costa told the board he has two employees stationed at the doors to check and count the number of customers entering. He later said he has private security guards on site, but was unable to provide the name of the security provider when asked.

The allegations of nightclub activities come from a March Incident in which Framingham police and Fire Staff responded to a medical incident. Although the incident was unfounded, public safety officials observed Cafe Belo operating beyond capacity with loud music and dim lights.
According to the state, a nightclub is defined as a densely populated place with characteristics such as low lighting, music above normal noise levels, late-night hours of operation, tables and seating that create poorly defined aisles, a specific area designated for dancing, and a beverage service area with limited food and beverage service.
Board members expressed concern that Cafe Belo was violating its entertainment license, which allowed acoustic guitar and a DJ with a keyboard. Several board members pointed to Cafe Belo's social media accounts, which promote bands and feature videos of large groups of people.
“Acoustic simply means the guitar, without any amplifier on it; that’s the spirit of this entertainment license,” Licensing Board Chairman Stu Pologe told Costa.
“I see a video here on Instagram of the Belo Carnival and you can see people dancing,” added curator Laura Medrano. “There is a band, there are women in skimpy clothes, it’s not a restaurant with an acoustic guitar.”

However, Pologe and Medrano both voted against the vote to suspend the entertainment license after Commissioner Shannon McCollough made the motion to suspend the entertainment license for 14 days. Medrano said 14 days would be detrimental to the business, something she did not want to see happen.
In addition to the suspension of his liquor license, Costa agreed to pay $300 in administrative costs. He is not allowed to appeal the decision regarding his liquor license under the agreement.
Decisions regarding Sunday entertainment are made by the mayor, which means that enforcement of the Sunday entertainment license suspension falls to Sisitsky.
