Michael Gargiulo's sentence postponed for Hollywood Ripper
The conviction of a man convicted of two murders which prosecutors dubbed The Boy Next Door Killer was postponed Friday following a request by the defense which requests a new trial because the accusation does not has not shared information that would have compromised the credibility of a detective who was a key witness in the case.
Jury recommended death penalty for 44-year-old Michael Thomas Gargiulo, who was convicted in August of the murders of two women, one of whom was about to date the actor Ashton Kutcher.
But the conviction has been delayed indefinitely while judge Larry P. Fidler is considering a defense request that came after revelations in a Los Angeles Times story that retired detective Mark Lillienfeld, a former case investigator de Gargiulo, posed as a member of parliament in 2018 and smuggled contraband. in a county jail while working as a prosecutor's investigator.
The violation was not related to Gargiulo's case, but his defense lawyers say the prosecution was required by law to disclose it to the defense so they can use it to attack his credibility as a witness and detective during the trial.
I think this is definitely a procedural violation, said Gargiulo's lawyer, Dale Rubin, during a break from the hearing.
Another hearing was scheduled on the motion in two weeks, and no new conviction date has been set. If the judge dismisses the application and the sentence is pronounced, the question could be likely to feed the defense in his appeals.
Prosecutors declined to comment in court.
Gargiulo, an air conditioning and heating repairer, bouncer and aspiring actor whose media nicknames included The Chiller Killer and The Hollywood Ripper but who was called The Boy Next Door Killer by prosecutors because he lived near his victims, was found guilty of the 2001 murder of Ashley Ellerin in her Hollywood home while she was about to go out with Kutcher, who testified at trial.
He was also convicted of killing Maria Bruno at her home in El Monte in 2005 and of the attempted murder in 2008 of Michelle Murphy, who pushed him back to his apartment in Santa Monica, forcing to flee and leaving a trace of blood which also led to his possible arrests for the other two murders. He is also at risk of being tried for a murder in 1997 in his hometown of Illinois.
