New York City Council Votes to Urge Public Schools to Create System-Wide Dress Code

The New York City Council voted Thursday to push local public schools to create a system-wide dress code.

For now, principals can adopt their own policies, leading to variations between schools. While the Ministry of Education proposes dress code tipsCouncil members said individual school rules can unfairly target LGBTQ+ students and students of color.

“There have been many incidents where students have been targeted because of the way they wear their hair“Public schools are not allowed to accept students who identify as a different gender,” East Harlem and South Bronx City Council Vice President Diana Ayala, a Democrat who co-sponsored the initiative, told reporters. “So we want to make sure that these things don’t happen in our public schools.”

The bill has two parts: First, the Department of Education must publish dress codes on its website and disclose the number of schools with policies, as well as violations and penalties broken down by race and gender. The city does not currently track the number of schools with dress codes.

“Each school has the discretion to make its own rules as it goes along,” Ayala said.

The Department of Education has defended its policies and said that while they support the intent of the legislation, the agency has concerns about record keeping. In 2021, the guidelines were updated to be more inclusive. For example, a gender-specific policy that banned low-cut shirts was revised to ban low-cut shirts, officials said.
