New York Public Schools Could Have a Universal Dress Code: Here's What It Means for Students
New York City public schools could soon have a universal dress code, thanks to new legislation approved by the City Council.
The new bill would require the city Department of Education (DOE) to post dress code policies on its website and report on dress code policies in public schools. This would include information on whether each school has a dress code policy and data on dress code violations and sanctions.
Under current DOE policy, schools can set their own dress code rules based on city guidelines. The policy states that students have the right to determine their own dress code unless the dress code is dangerous, interferes with the teaching and learning process, or violates the DOE’s anti-discrimination policy.
This means that dress code policies in schools can currently vary widely.
According to a committee report, City Council members said the DOE does not have a universal dress code policy to protect students from the unfair enforcement of discriminatory and sexist dress standards in schools. The report cited multiple studies that found students face hypersexualization, as well as discrimination based on clothing that reflects their religious identity, according to Girls for Gender Equity. The nonprofit also found that school dress codes target girls, as well as transgender and gender nonconforming (TGNC) youth of color.
Council members called on the city to create an inclusive school dress code policy that complies with federal law and takes into account cultural diversity, gender expressions and body diversity. Eliminating gender-based dress codes would ensure that students are not mistreated or discriminated against based on their attire and would create safe and inclusive school environments for all youth, the report said.
This new bill would require the DOE to report on dress code policies at each school, including whether schools have dress code policies, details about what those policies contain, disciplinary provisions, and whether those policies are posted on school websites.
Additionally, the bill would require information on how dress code policies address gender and gender presentation, and whether they create different expectations for different genders.
Reports on these policies would also include data on dress code violations and sanctions, broken down by month, week and student gender.
If the mayor signs the bill, it will take effect immediately.
