Trump is an enemy within. Treat it as such.

Hearings by the House Committee investigating the Jan. 6 insurrection have already provided conclusive evidence that the effort to nullify the 2020 election was a plot led by a corrupt sitting president who knew the effort was based on lies and encouraged violence in the pursuit of power.

The damning testimony before the committee and the persuasiveness of his case have been widely analyzed. But a frank discussion of responsibility for the insurgency has been muted.

There is a reason for this. The gravity of the crime exceeds anything a US president has ever been suspected of committing, and the scale of the culpability is greater than many citizens are comfortable contemplating.

Another reason, which puts the country at risk, is that too many Americans continue to support the authors.

Representative Bennie G. Thompson of Mississippi, Democratic chairman of the House Select Committee investigating the Jan. 6 attack on the United States Capitol, set the tone for the hearings a week ago in his opening statement.

It was the national enemies of the Constitution who stormed the Capitol and occupied the Capitol who sought to thwart the will of the people to stop the transfer of power, he said. He later said: Ultimately, Donald Trump, the President of the United States, instigated a host of domestic enemies of the Constitution to come down from Capitol Hill and overthrow American democracy. January 6 was the culmination of a coup attempt. The violence was no accident. It represented Trump’s last, most desperate chance to stop the transfer of power.

Thompson’s use of the phrase domestic enemies was deliberate. He noted the Civil War-era adoption of language regarding all foreign and domestic enemies in the Federal Oath to Account for the Southern Rebellion.

In other words, the crimes committed by Trump and his accomplices categorically amount to a war against the United States.

What is the appropriate punishment? If Trump and those who joined him in this violent coup attempt, including lawyers John Eastman, Rudy Giuliani and Sidney Powell, and seditionist members of Congress such as Representatives Lauren Boebert of Colorado, Jim Jordan of ‘Ohio and Arizona’s Andy Biggs, other senior officials like Trump’s chief of staff, Mark Meadows, and the hundreds of extremists who have stormed the Capitol are enemies of America, whom do with them?

The answer comes to mind more easily than his given voice. We know the essence of the appropriate punishment for the crime. We don’t know yet how to hire him.

Much has been made of specific federal laws that Trump likely violated. These were suggested by the committee in March when it asked a U.S. District Court in California to compel Eastman to turn over documents. He argued that Eastman’s attorney-client privilege defense was struck down because his relationship with Trump involved the probable commission of two federal crimes: obstruction of official process and conspiracy to defraud the United States. Judge David O. Carter agreed.

Dr. Eastman and President Trump launched a campaign to nullify a Democratic election, an action unprecedented in American history, Carter wrote. Their campaign was not confined to the ivory tower, it was a coup in search of legal theory.

These specific alleged criminal offenses are an inherent theme of the Committee’s recent public hearings. It’s as if the panel were laying out a roadmap for Attorney General Merrick B. Garland to pursue criminal charges, as the New York Times put it.

The depth of the catastrophe that awaits the country if Trump and the Republicans are rewarded for the insurrection cannot be overstated.

Yet a case involving mere criminal codes and a jury of peers, however necessary, would overlook the enormity of Trump’s betrayal of America, for a crime on the scale of a violent coup attempt by the country’s own president eludes the ability of any court to fully answer. Only a wave of public contempt, a deep condemnation by the citizens, the eternal disapproval of history could correspond to these misdeeds.

And such contempt must also target the Republican Party, which as an organization has been indispensable in supporting its criminal figurehead and clearing space for its betrayal. Trump and his accomplices should face the kind of justice dispensed by society down through the ages reserved for the nations most hated scoundrels.

But it doesn’t happen.

Garland, to the exasperation of many pro-democracy Americans, seems ambivalent about prosecuting Trump and other high-profile seditionists. It’s not hard to find people repeating the usual arguments against prosecuting a former president, the national trauma would be too great, it would be labeled politically motivated, it could spark a partisan exchange even if not punishing Trump would prove that the individuals who are able to inflict the most damage are the most immune from liability.

In fact, the culprits don’t just get away with serious crimes. They are booming. Trump is preparing to become president again. Election naysayers are the top GOP contenders for the highest offices in Colorado and elsewhere. Republicans in November have a good chance of regaining a majority in the US Senate and are almost certain to regain a majority in the US House. When that happens, seditionist lawmakers will occupy even higher positions of power, one of the most disheartening examples being Jordan, a vocal Trump sycophant who is on his way to being the next Judiciary Committee Chairman and is already salivating. on the retaliatory investigations he plans to carry out. launch.

The depth of the catastrophe that awaits the country if Trump and the Republicans are rewarded for the insurrection cannot be overstated.

That the Americans must still today tolerate the presence of seditionists in elective mandates demonstrates that January 6 was not a crisis avoided but only the spectacular expression of a crisis in progress.

That Americans must watch as a free Trump plots a second presidential race reveals that the justice system, so dependent on the good faith will of public officials to uphold the law, is overwhelmed by deception and boundless corruption.

That Americans in large numbers continue to support Trump signals that the country established by the US Constitution is already mutating into a dark new form that the Founders would not recognize.
