The Islamabad High Court (IHC) on Sunday approved bail ahead of the arrest of PTI leader Imran Khan, a day after an arrest warrant was issued for the former prime minister in related to his controversial remarks against Additional District and Sessions Judge (ADSJ) Zeba Chaudhry. and other officials at a public rally on August 20.

Imran’s arrest warrant, dated September 30, was issued by senior civilian judge Rana Mujahid Rahim. As details of the warrant emerged, PTI workers and leaders converged on Banigala to thwart any arrest attempts, once again warning that he was a “red line”.

According to Islamabad Police, after the Islamabad High Court quashed the terrorism charges in the registered case against Imran, the case was transferred to a court hearing and the PTI chief did not obtained his release on bail.

Police also said he also did not attend the final court hearing in the case and the warrant was issued for his attendance.

Subsequently, Imran filed a petition with the IHC on Sunday through his lawyer Babar Awan.

In his plea, Imran said a terrorism case was initially filed against him but the charges were later overturned by the High Court and the case transferred.

He alleged that the coalition government had filed a false complaint against him, the purpose of which was to stifle the peaceful movement against the “corruption mafia”.

According to the plea, the purpose of the case was to arrest Imran in order to end a “peaceful political movement”.

Judge Mohsin Akhtar Kayani accepted the request of the head of the PTI and prohibited the Islamabad police from arresting Imran. The court approved Imran’s bail against the submission of bonds worth Rs 10,000.

The IHC also ordered Imran to appear in the relevant court by Friday.

Speaking to the media outside the court, Awan said the IHC had granted the PTI chief a “transitional protective release before the arrest”, adding “we will appear in the lower court before October 7. “.

Awan said he appeared before Judge Kayani and raised a few “factual points” about the case.

“I told him that we had already secured bail in this case as well as the fact that these charges could not proceed as they are unrecognized offences,” he said.

The PTI chief’s lawyer said everything that happened last night was ‘very dangerous’ as the whole country stood up without any appeal. “This imported government must see Imran’s power.”

He was of the view that lawyers, peasants, workers, students, youths as well as the whole of Pakistan would take to the streets once the party leader gave the date for his long march.

He said it would now be the PTI’s turn to file complaints based on “truth and facts”, adding that the government would no longer be able to file complaints.

CONTEMPT CASE

The decision to initiate contempt proceedings against Imran was made by IHC Judge Aamer Farooq on August 22 during the hearing of a motion challenging Gill’s pre-trial detention by police. The court summoned Imran on August 31 and then issued him with a show cause notice.

The day before the hearing, the former prime minister had filed a reply to the IHC in which he expressed his willingness to “take back” his remarks about Judge Chaudhry if they were “considered inappropriate”. He had argued before the IHC that judges who had agreed to prosecute him should consider stepping down from the bench because he said they had prejudged the case.

However, the IHC had deemed the response “unsatisfactory” and asked the head of the PTI to submit a “considered” response.

Following this, Imran submitted another response to the court. In the revised response, Imran stopped short of issuing an unconditional apology.

On September 8, the IHC decided to charge Imran, again calling his response “unsatisfactory”.

However, at the next hearing on September 22, when charges were expected to be brought against the PTI leader, Imran offered to apologize to Judge Chaudhry and escaped the act. of accusation.

Following his statement to the court, the largest formation handling the case said it was “satisfied” with the apology and asked the head of the PTI to submit an affidavit.

Before submitting the affidavit, Imran appeared in a court in Islamabad on Friday to personally apologize to Judge Chaudhry, but his apology was left on hold as the judge was on leave.

Meanwhile, in his affidavit, Imran said he “realized during these (contempt) proceedings in the honorable court that he might have crossed a red line.” However, he added, he never intended to threaten Judge Chaudhry and “there was no intention behind that statement to take any action other than legal action”.

He said he wanted to assure the IHC that he was willing to explain and clarify before Judge Chaudhry that “neither he nor his party were seeking/seeking any action” against her and that he was willing to apologize to her “if she felt like the affiant (Imran) had crossed a line”.

He also expressed his willingness to take any other action that the IHC “deems necessary and appropriate for the satisfaction of the honorable court that it was never intended to interfere in the process of the court or to undermine the dignity or independence of the judiciary”.
