SC challenged following dismissal of disqualification petition against Imran Khan in Tyrian White case

The decision to dismiss the disqualification petition against Pakistan Tehreek-e-Insaf (PTI) founder and chairman Imran Khan in the Tyrian case was challenged in the Supreme Court.

An appeal has been filed against the Islamabad High Court's decision to dismiss the disqualification petition against Imran Khan. Citizen Muhammad Sajid, through his lawyer Riffat Hussain, filed an appeal in the Supreme Court, accusing Imran Khan, the Election Commission of Pakistan and the government.

The appeal seeks reversal of the Islamabad High Court's May 21, 2024 decision.

The petition states that the PTI founder did not disclose his daughter Tyrian White in his documents and submitted a false affidavit. Paternity was proven in a California court.

The petition contends that IHC did not give the petitioner an opportunity to complete his arguments in this matter. All three members of the High Court heard the case and reserved the decision.

The petitioner said Islamabad High Court Chief Justice Aamer Farooq had not announced his decision and two judges had uploaded their decision on the website. The petition claims that the decision of the two judges is not in accordance with the law, as a three-member panel can decide by a majority of two to one.

The appeal asks the Supreme Court to accept the appeal against the Islamabad High Court's decision and accept the disqualification petition against the PTI founder.

On May 21, the Islamabad High Court declared the petition filed against Imran Khanin Tyrian Whitecase inadmissible.

Citizen Muhammad Sajid sought disqualification of Imran Khan on the grounds that he did not show his alleged daughter in his nomination papers. Former attorney general Salman Aslam Butt, appearing as the petitioner's lawyer, had submitted additional documents, including a statement dated November 18, 2004, of Imran Khan's former wife Jemima Khan.

The statement said she made the statement in support of Tyrian Jade Khan White's request, which called for Caroline White (sister of Tyrian's mother, Ana Louisa Sita White) to be named Tyrian's guardian.

The statement further stated that Jemima Khan refused to serve as a Tyrianguardian.

Ana Louisa (Sita) White was the daughter of Lord Gordon White, who headed the American branch of a large industrial group, Hanson PLC.

The petitioner, Sajid Mahmood, alleged that the PTI president did not marry Sita White because his racist father had explicitly told the accused (Imran Khan) that if he married Sita White, neither of them would receive a cent of his wealth.

It was mentioned that it was after this that Imran Khan met another rich woman, Jemima, and married her in a very short time.

The petition also highlighted the events in which custody of Tyrian Jade was given to Jemima.

He said Ana Louisa White, in her will dated February 27, 2004, had named Jemima Khan as guardian of her daughter Tyrian Jade Khan White. Later that year, on May 13, Sita White died.

The petition stated that Jemima Goldsmith was the wife of Imran Khan from 1995 to 2004.

The petition claimed that the hidden facts were verified by a California court ruling, which declared that the accused (Imran Khan) was the father of Tyrian Jade.

He further said that Imran Khan initially participated in the case through his lawyer but later withdrew from the case when he was asked to do a simple blood test.

The petition alleged that later, when Sita White's sister, Caroline White, asked the court to appoint her as guardian of the Tyrians, she submitted a declaration to the court.
