SC requested reversal of IHC decision on Tyrienne case

ISLAMABAD – A petition has been filed in the Supreme Court asking it to declare null and void the decision of the Islamabad High Court (IHC) declaring inadmissible the petition seeking disqualification of the founding president of Pakistan Tehrik-e-Insaf (PTI), Imran Khan, for hiding his alleged daughter Tyrian White in his nomination papers.

Petitioner Muhammad Sajid filed leave to appeal under Article 185(3) of the Constitution against the short order dated May 21, 2024 passed by the full bench of the IHC.

He cited Imran Khan of the Election Commission of Pakistan and the Federation through the Ministry of Law and Justice as respondents. He asked the Supreme Court to allow the appeal of the IHC decision, declaring it null and void by ruling the former prime minister ineligible to hold any public office.

On May 21, the IHC had rejected his petition, seeking disqualification of Imran for concealing his alleged daughter on the grounds that a three-member bench had already dismissed the same petition on May 10, 2023 by two judges to one. However, the petitioner argued that a three-member bench of the IHC, comprising Justices Tariq Mehmood Jahangiri, Arbab Mohammad Tahir and Saman Rafat Imtiaz, had taken up the petition after a gap of almost a year. He argued that when the case was heard by three judges, the opinions of two of them were uploaded on the court's website before the date fixed for the announcement of the verdict. The petitioner questioned whether the concurring opinion of two judges could be considered a judgment under the law established by this court.

He added that whether the entire bench of the IHC had erred in considering the concurring opinion of two judges of the High Court as a judgment and dismissing the petition accordingly, he questioned and further asked whether the contested order was silent.

He contended that on November 18, 2004, Imran Khan signed a declaration in Lahore and refused to serve as guardian himself and nominated Carolina to be appointed as Tyrian's guardian on the grounds that it would be in Tyrian's best interest.
