Court rejects Imran Khan and Bushra Bibi's requests to suspend their sentences

ISLAMABAD: In a major upset for Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife Bushra Bibi, a district and sessions court in Islamabad on Thursday rejected their pleas for suspension of sentences in the iddat affair.

The PTI founder and Bushra were each sentenced to seven years in prison in February this year after a trial court found their nikah fraudulent as Khawar Maneka, Bushra's ex-husband, moved the court against the couple's marriage.

Additional Sessions Judge Afzal Majoka today announced the verdict on the appeals against the sentence, which was reserved on June 25.

Meanwhile, the hearing on the main plea relating to the overturning of the couple's conviction is expected to take place on July 2.

In the 10-page order, the court mentioned that there was no reason to suspend the sentence.

“…[there is] no grounds for suspension of [the] the sentence is available to both applicants. Accordingly, both the petitions under Section 426 Cr.PC stand dismissed,” it said.

Responding to the trial court's verdict, PTI General Secretary Omar Ayub Khan said: [We] will immediately challenge the verdict in the High Court.

Following the announcement, PTI workers started protesting outside the district and sessions court and also blocked the road. Among the demonstrators, there are women who chant slogans in favor of the PTI founder.

Meanwhile, a large police deployment is present outside the court.

Khan, currently incarcerated at Adaila Prison in Rawalpindi, would likely be released if the verdict was in his favor. The PTI founder remains acquitted in the Toshakhana and Chiffre cases respectively, while his £190 million guarantee was also approved.

Khan was also released on bail in the cases registered on May 9 in Lahore, Rawalpindi and Faisalabad. On the other hand, the Federal Investigation Agency also questioned him twice in prison regarding an anti-state message shared on X, formerly Twitter. There is, however, no new case against the PTI founder.

What is iddat case?

The case first surfaced when a petitioner, Muhammad Hanif, had claimed that Bushra Bibi had divorced her ex-husband in November 2017 and married Khan on January 1, 2018, despite the fact that her iddat period when a woman goes into seclusion after the death or divorce of her husband had not ended, “which is against Sharia and Muslim norms.”

A district and sessions court in Islamabad later rejected the plea. The court declared the petition inadmissible and declared that it did not fall within its jurisdiction, before which the petitioner withdrew his plea.

Later, Bushra's former husband Khawar Maneka had filed a case against Khan and Bushra's “un-Islamic marriage” in the court of Civil Judge Qudratullah on November 25, 2023, under sections 34, 496, 496- B from Pakistan. Penal Code.

The couple was indicted in the iddats case on January 16, 2024. After a 14-hour hearing in Adiala prison, the trial court reserved its verdict on February 2 and sentenced each to seven years of Imprisonment of Imran and Bushra on February 3.

The case was also heard earlier by Sessions Judge Shahrukh Arjumand against whom Maneka had shown lack of confidence, seeking transfer of the case to Justice Majoka's court from the Islamabad High Court.

The former first couple was represented by their lawyers Salman Akram Raja, Salman Safdar and Usman Gill in the case. Meanwhile, lawyer Zahid Asif argued in favor of Maneka, opposing appeals against the suspension of the sentence.
