Imran lost his case in court in Iddat case

ISLAMABAD':

A district and sessions court on Thursday dismissed an appeal filed by former prime minister Imran Khan and his wife Bushra Bibi seeking to stay a February ruling that their 2018 marriage violated Islamic law.

Additional District and Sessions Judge (ADSJ) Afzal Majoka announced the verdict, which was reserved on Tuesday. The court's decision means that the PTI founder and his wife will remain behind bars.

The seven-year prison sentence handed down on February 3 came five days before the country's general election and follows two other convictions against Khan in separate cases. Both have since been overturned.

In his written order, the judge cited an earlier judgment and noted: “It can be said that a convict cannot seek bail as of right even in the case of an offence which is bailable under Section 426. [of] CrPC.

“Therefore, by the same analogy, it cannot be said that [a] Convicted women are entitled to bail under section 426 [of] CrPC as first provision of sub-section (1) of section 497 [of] “CrPC,” he added.

“The summary of the above discussion is that no grounds for suspension of sentence are available to the two petitioners. Accordingly, applications under Article 426 [of] “The CrPC members are hereby dismissed,” the order said.

The matrimonial suit against the couple was filed last year by Bibi's former husband, Khawar Maneka, who alleged that his divorced wife failed to observe the three-month break required by Islamic law before marry Khan.

Maneka claims to have divorced his wife in November 2017. Khan announced his third marriage to Bibi in February 2018, months before becoming prime minister.

The couple have repeatedly appealed the conviction, asking for the ruling to be stayed. Another appeal by Khan and Bibi to overturn the February conviction is scheduled to be heard from July 2.

Opposition leader in the National Assembly Omar Ayub Khan condemned the court's decision and said an appeal would be filed.

In a statement released on Wednesday, the PTI warned that a new political crisis would erupt in the country if Khan was not released. “The former prime minister was imprisoned for 11 months, while during this period he was acquitted or released on bail in 18 different cases,” PTI said in its statement.

Speaking to the media, he reiterated that no dialogue would take place with the government until all PTI leaders and workers were released.

The PTI called the development “absolutely ridiculous”. In a post on its official X account, the PTI said the matter was “unprecedented, despicable in the history of our country and in Islamic history” and had been “globally condemned and caused immense embarrassment to Pakistan”.

“Every individual responsible for making and transporting this matter will fall into the dirtiest, darkest alleys of history,” he asserts.

Rana Sanaullah, a top leader of the ruling Pakistan Muslim League-Nawaz (PMLN), had recently claimed that Khan's speech was aimed at creating chaos in the country.

Khan and his wife had previously been sentenced to a separate 14-year prison term in a case related to the illegal sale of state gifts, but in April their convictions were overturned by the Islamabad High Court.

Khan was also sentenced to 10 years in prison for leaking state secrets, as was former foreign minister Shah Mahmood Qureshi.

Earlier this month, the Islamabad High Court overturned that verdict, but Khan remained behind bars due to his conviction in the illegal marriage case.
