Imran Khan's party seeks full hearing in 'disenfranchisement' case

Islamabad [Pakistan]June 30 (ANI): Pakistan Tehreek-e-Insaf on Saturday moved the Supreme Court to settle its review petition challenging the decision to deny the party its 'bat' symbol for the general elections, the daily reported Pakistani Dawn.

The scope of the judgment under review is already being debated before all the judges in the reserved seats case, the petition said while referring to the reserved seats case which is being heard by all the judges of the Supreme Court.

The question is whether the removal of the PTI's 'bat' symbol resulted in non-allocation of reserved seats or whether the ECP misinterpreted the Supreme Court order, Dawn reported.

The issue of reserved seats and their right would remain “unresolved” unless it is heard in conjunction with the reserved seats case by the top court, the PTI argued in its petition and also sought an early hearing , otherwise the petitioner would “suffer irreparable loss and damage.” “.

PTI's argument that the application raised fundamental and important issues which required hearing by a larger bench was accepted and the applications were considered by a five-judge bench, Dawn reported.

In its petition, the party said the implementation of the Supreme Court's January 13 judgment was causing “immense loss to the PTI and the public” at large, who were being “deprived of the right” to elect the party of their choice in the general elections.

PTI members were unable to contest the elections under a common symbol due to the said judgment in which the court upheld the ECP's order of December 22, 2023 to deprive the party of its election symbol, Dawn reported.

“The issue in question involves violation of basic fundamental rights guaranteed under the Constitution and the delay in deciding the matter is fatal.” On Sunday, Supreme Court of Pakistan Justice Athar Minallah asked the Election Commission of Pakistan (ECP) to convince the Supreme Court that the Pakistan Tehreek-i-Insaf had been rightfully excluded from the electoral process, thereby losing its right to reserved seats.
