Former Pakistani Prime Minister Khan arbitrarily detained, UN panel says

A UN panel of experts has determined that the detention of former Pakistani Prime Minister Imran Khan was arbitrary and a violation of international law, calling for his “immediate” release.

In an opinion released Monday, the United Nations Working Group on Arbitrary Detention expressed serious concerns about the multiple prosecutions against Khan since his ouster in April 2022.

She considered that this deprivation of liberty violated a series of international laws and standards and was “arbitrary”.

“Khan’s detention had no legal basis and appears to have been intended to prevent him from running for political office,” the task force concluded.

“Thus, from the outset, these proceedings were not based on the law and were allegedly used for political purposes,” said the opinion, dated March 25 but only made public on Monday.

The working group, made up of five independent experts, whose opinions are not binding but have reputational value, called on the Pakistani government to “take the necessary measures to remedy Mr. Khan's situation without delay and put it into effect.” compliance with relevant international standards.

Khan, who served as prime minister from 2018 to 2022, has been involved in more than 200 legal cases since his ouster, in what he says is a campaign to remove him from power.

He has been detained since August last year and cannot run for office.

However, the former international cricket star and his wife had their 14-year prison sentence for corruption suspended by a Pakistani high court in April.

Khan later had his 10-year prison sentence for treason overturned this month, but he remains in Adiala prison, south of the capital Islamabad, on a conviction for illegal marriage.

He had been allowed to be released before these three convictions were handed down in the days before Pakistan's February 8 general elections.

Neither Pakistan's interior ministry nor its information ministry immediately responded to a request for comment.

Khan's party, Pakistan Tehreek-e-Insaf (PTI), hailed the decision as “a huge victory”.

“This has shown beyond doubt that Imran Khan is innocent and has been thrown into jail illegally,” PTI spokesperson Syad Zulfiqar Bukhari said in a statement.
