Trump Immunity Case: Read the Supreme Court Decision in Full | Donald Trump Trial

The Supreme Court has ruled that a former president enjoys absolute immunity for his core constitutional powers. The decision was made along party lines, with six conservative justices ruling against three liberal justices.

But the court says former presidents are not entitled to immunity from prosecution for acts committed in a private capacity.

Monday's ruling is a victory for Donald Trump, significantly reducing the likelihood that the federal criminal case against him, accused of conspiring to obstruct the transfer of power, will continue before the 2024 election.

In his opinion, Chief Justice John Roberts said:

Under our constitutional structure of separation of powers, the nature of the presidential power provides a former president with absolute immunity from criminal prosecution for acts within his final and exclusive constitutional authority. He is entitled to at least presumptive immunity from prosecution for all his official acts. There is no immunity for unofficial acts.

Justice Sonia Sotomayor, writing in dissent, said the court's decision in Trump's immunity case made a mockery of the principle that no man is above the law.

She wrote:

The decision to grant criminal immunity to former presidents reshapes the institution of the presidency. It flouts the fundamental principle of our Constitution and our system of government, according to which no one is above the law.

The indictment paints a dark portrait of a president desperate to stay in power, she continued.

Because our Constitution does not protect a former president from prosecution for criminal acts and treason, I disagree.
