Imran Khan's detention violates international law, says UN working group

WASHINGTON – The detention of former Pakistani Prime Minister Imran Khan is arbitrary and a violation of international law, a U.N. human rights working group said in an opinion released Monday, adding that the jailed politician should be released immediately.

The Geneva-based UN Working Group on Arbitrary Detention said that “the appropriate solution would be to release Mr. Khan immediately and grant him an enforceable right to compensation and other reparations, in accordance with international law.”

The UN working group said Khan’s legal troubles were part of a “much broader campaign of repression” against him and his party, the Pakistan Tehree-e-Insaf (PTI). It said that in the run-up to the 2024 elections, members of Khan’s party were arrested and tortured and their rallies were disrupted. It also denounced “widespread fraud on election day, which stole dozens of parliamentary seats.”

The Pakistani embassy in Washington had no immediate comment. Pakistan's election commission denies the election was rigged.

Khan has been in prison since last August and was convicted in several cases ahead of national elections in February. He is also on trial in dozens of other cases that are still ongoing. Khan and his party say the charges were politically motivated to thwart his return to power.

In recent months, Pakistani courts have suspended Khan's prison sentences in two cases involving the illegal acquisition and sale of state gifts, and also overturned his conviction for leaking state secrets.

He remains in prison, however, due to a conviction in a separate case in which a lower court ruled his 2018 marriage was illegal. Khan also faces trial on terrorism charges related to last May's violence.

Khan came to power in 2018 and was ousted in 2022 after falling out with Pakistan’s powerful military. He has accused the U.S. and Pakistani militaries of playing a role in his ouster in a parliamentary vote of no confidence. Both deny the accusations.

Several legal proceedings were filed against Khan after his ouster, disqualifying him as a candidate in the February election.

Although they did not run themselves, Khan-backed candidates won the most seats, but the Pakistan Muslim League-Nawaz (PML-N) and the Pakistan Peoples Party (PPP) formed a coalition government.

The United States, Britain and the European Union have expressed concern over reported irregularities in the election and called for an investigation, while United Nations Secretary-General Antonio Guterres has expressed concern over violence and the suspension of mobile communications services during the election.
