WASHINGTON (Reuters) – The detention of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan is arbitrary and a violation of international law, a U.N. human rights working group said in an opinion released on Monday, adding that the jailed politician should be “released immediately.”

The Geneva-based UN Working Group on Arbitrary Detention said that “the appropriate solution would be to release Mr. Khan immediately and grant him an enforceable right to compensation and other reparations, in accordance with international law.”

The UN working group said the former prime minister's legal troubles were part of a “much broader campaign of repression” against him and his party.

He highlighted the arrests of several PTI leaders and alleged torture in custody, as well as restrictions on holding election rallies ahead of the February 8 general elections.

In addition, he also denounced “widespread fraud on election day, which stole dozens of parliamentary seats.”

The Pakistani embassy in Washington had no immediate comment. The Election Commission of Pakistan (ECP) has denied that the elections were rigged.

The cricketer-turned-politician, who came to power in 2018, was ousted as prime minister in April 2022 in a no-confidence vote led by the then-united opposition comprising mainly the Pakistan Muslim League-Nawaz (PML-N), the Pakistan Peoples Party (PPP) and the Jamiat Ulema-e-Islam (JUI-F), also known as the former Pakistan Democratic Movement (PMD).

The alliance then formed a coalition government to complete the remaining term of the National Assembly.

Since his ouster, Imran has faced a series of charges ranging from corruption to terrorism.

The PTI founder has been in jail since last August and has been convicted in several cases ahead of this year's national elections. He is also on trial in dozens of other cases that are still ongoing.

On August 5, an Islamabad trial court had convicted the PTI founder in a Toshakhana case filed by the ECP and sentenced him to three years in jail. The conviction earned him a five-year ban from voting by the election body, but the Islamabad High Court (IHC) suspended the sentence.

The ousted prime minister and his party say the charges against him were “politically motivated” to thwart his return to power in this year's elections.

He has accused the United States of playing a role in his ouster by collaborating with his political rivals. Both deny the accusations.

In recent months, courts have suspended Khan's prison sentences in two cases related to the illegal acquisition and sale of state gifts, and also overturned his conviction for leaking state secrets in the encryption case.

However, he remained behind bars due to his conviction in the iddat case in which a trial court ruled that his 2018 marriage was illegal. Imran Khan and his wife Bushra Bibi had sought suspension of the sentences in the case, but the trial court rejected the requests last month, blocking the 71-year-old politician's release.

He is also accused of participating in violence last May and is being tried for terrorism.

Numerous legal proceedings were initiated against the PTI founding chairman after his ouster, one of which also disqualified him as a candidate in the February elections.

Although they did not run, the PTI-backed candidates won the most seats, but the PML-N and the PPP mustered the numbers needed to form a coalition government.

The United States, Britain and the European Union have expressed concern over reported irregularities in the election and called for an investigation, while United Nations Secretary-General Antonio Guterres has expressed concern over violence and the suspension of mobile communications services during the election.
