UN says detention of former Pakistani PM Imran Khan is arbitrary and must be released immediately

A UN working group said on Monday that the detention of former Pakistani Prime Minister Imran Khan was arbitrary and contrary to international law, and that he should be released immediately.

In an opinion, the UN Working Group on Arbitrary Detention called for measures to “remedy Mr. Khan's situation without delay,” which would include releasing him “immediately and granting him an enforceable right to compensation and other reparations, in accordance with international law.”

Khan came to power in 2018 and was removed in a no-confidence vote in 2022. Since then, hundreds of cases have been registered against him, ranging from corruption to terrorism.

He has been in prison since last August and was convicted in three cases ahead of February's general election, in which candidates backed by his party won the most seats but failed to form a government.

Khan and his party claim the cases were politically motivated, aimed at preventing him from coming to power.

His prison sentence for illegally acquiring and selling state gifts (the Toshakhana case) was suspended, while his conviction for leaking state secrets was also overturned. But he remains in prison due to a conviction for illegal marriage, and also faces charges related to the May 9 violence, when people stormed military installations after his initial arrest.

The task force said Khan's arrest, detention and prosecution in the first Toshakhana case, where he was accused of concealing details of state gifts he had received, and in the encryption case, where he was accused of leaking a secret cable, were “without any legal basis” and appeared “politically motivated to exclude his participation in the election”.

Calling on Islamabad to disseminate the UN report “as widely as possible”, he added that the government had not responded to his communication dated last November.

Stressing that “no trial” of Khan “should have taken place,” the 17-page document noted: “Given his age, Mr. Khan currently faces an effective sentence of life imprisonment.”

She called on Islamabad to “ensure a full and independent investigation into the circumstances surrounding Mr Khan's arbitrary deprivation of liberty and to take appropriate action against those responsible for the violation of his rights.”

The Pakistani government did not immediately comment on the notice.
