Trump seeks to overturn bribery verdict after immunity ruling

Donald Trump's lawyers said in a letter to the judge presiding over the former president's silence case that they want him to delay sentencing and overturn the trial verdict following the Supreme Court's ruling on presidential immunity on Monday.

The lawyers said they wanted to brief New York state Judge Juan Merchan on the relevance of the high court's immunity ruling and an argument that the decision confirmed that the Manhattan district attorney should not have been able to present evidence at trial about Trump's official acts as president.

Trump's lawyers are seeking to overturn his conviction on 34 counts of falsifying business records and postpone sentencing from next week, according to two people with direct knowledge of the matter.

Trump has pleaded not guilty to the charges, which stem from a silence payment by his former lawyer Michael Cohen to adult film star Stormy Daniels in the final weeks of the 2016 presidential campaign.

News of the lawyers' plan to file the motion was first reported by The New York Times.

Trump’s lawyers pointed to an element of the Supreme Court opinion that limits the evidence that can be used at trial. Trump is scheduled to be sentenced in 10 days. Many of the actions presented as evidence at the bribe trial took place before Trump took office in 2017. The events that occurred after he took office involved checks he wrote on his personal account while president and documents prepared by his company. Prosecutors also pointed to a meeting between Trump and Cohen at the White House.

The district attorney's office declined to comment Monday evening.

The Supreme Court ruled 6-3 on Monday, along ideological lines, to reject Trump’s request for immunity in his federal election interference case. Charges related to Trump’s efforts to overturn the 2020 election results will not be dismissed, but prosecutors in the special counsel’s office are barred from certain actions closely related to his core duties as president.

The immunity ruling is expected to further delay the case, all but guaranteeing that the trial will not begin until Election Day.
