Donald Trump seeks to overturn New York corruption conviction hours after Supreme Court ruling on immunity

NEW YORK — Hours after the U.S. Supreme Court issued its landmark ruling on presidential immunity, former President Donald Trump sought Monday night to have his conviction overturned in New York.

Trump's lawyers said the verdict should be overturned because the jury saw evidence during the trial that they said should have been protected by presidential immunity, according to a letter to Judge Juan Merchan, described by sources to ABC News.

The defense has requested additional time to present its arguments, a move that could delay Trump's sentencing, currently scheduled for July 11.

Trump's legal team had no comment. The Manhattan district attorney's office declined to comment.

It took the jury less than 10 hours to convict Trump on 34 counts of falsifying business records related to a secret payment to porn star Stormy Daniels. Trump’s lawyer at the time, Michael Cohen, wired Daniels $130,000, and Trump paid him back in monthly installments disguised as ongoing legal fees.

Trump's defense team had previously raised the presidential immunity argument in an unsuccessful attempt to limit evidence and delay the trial.

In March, defense lawyers sought to exclude a government ethics form that disclosed Trump's reimbursement to Cohen as well as a series of 2018 tweets that prosecutors said were part of a “pressure campaign” against Cohen.

“By these appropriate standards, President Trump’s social media posts and public statements—while acting as president and viewed in context—were within the outer perimeter of his presidential duty, for which communicating with the public on matters of public concern was essential,” Trump’s lawyers wrote in the March motion that the judge denied before trial.
