Donald Trump's sentencing in hush-money case likely to be delayed by at least two weeks

The verdict in Donald Trump's Manhattan trial over his gag order was thrown out Tuesday after prosecutors ruled the historic event should be postponed in light of the U.S. Supreme Court's ruling granting presidents immunity for “official acts.”

The Manhattan district attorney's office wrote in a letter Tuesday that it does not object to the former president's July 11 sentencing in the business records tampering case being postponed so Judge Juan Merchan can rule on Trump's claim that prosecutors improperly used evidence from the trial of his time in the White House.

Prosecutors, writing that they believe Trump's arguments are “meritless,” nevertheless agreed that the proceedings should be delayed while the judge rules on the presumptive Republican presidential nominee's claims.

While we find the defendants' arguments to be without merit, we do not oppose his request for leave to testify and his purported request to adjourn sentencing pending the determination of his motion, prosecutors wrote.

District Attorney Alvin Bragg's office requested a July 24 deadline to respond to Trump's motion, which his defense attorneys, Todd Blanche and Emil Bove, requested permission to file by July 10.

If Merchan approves the schedule, Trump would not be sentenced until July 25 at the earliest, although it is also possible that the hearing could be pushed back beyond that date.

The delay would mean that Trump's punishment in the case would remain on hold until he officially wins the GOP nomination at the Republican National Convention in Milwaukee, which begins July 15.

Trump, 78, faces up to four years in prison, but could also be sentenced to probation or community service, after a Manhattan jury convicted him on May 30 of concealing a $130,000 payment to porn star Stormy Daniels for hiding from voters alleged details of a sexual encounter before the 2016 presidential election.

The prosecutor's letter comes a day after Trump's camp wrote a letter, which was posted to the court's public registry Tuesday, urging Merchan to overturn the conviction in light of the Supreme Court ruling, which limits how prosecutors can use evidence of a president's “official acts” to bring charges.

“This evidence of official acts should never have been presented to the jury,” attorneys Blanche and Bove wrote.

“After further information on these matters… it will be evident that the result of the trial cannot be upheld,” they added.

The hush money at the heart of the case was not an “official” presidential act but rather a personal one, according to an April 2023 ruling by Manhattan District Judge Alvin Hellerstein.

“The evidence overwhelmingly suggests that this was a purely personal matter for the president, a cover-up of an embarrassing event,” Hellerstein wrote. “Paying an adult film star to keep quiet is not related to the official actions of a president. It in no way reflects the color of the president’s official duties.”

Bragg's prosecutors used evidence in the gag order trial from Trump's time as president, including checks he wrote from the Oval Office and social media posts he made while commander in chief.
