Trump seeks to overturn New York bribe verdict

NEW YORK (AP) — Lawyers for former President Donald Trump have asked the New York judge who presided over his hush-money trial to overturn his conviction and delay his sentencing, scheduled for next week.

The letter to Judge Juan M. Merchan cited the U.S. Supreme Court's ruling earlier Monday on presidential immunity and asked the judge to delay sentencing Trump while he weighs the high court's decision and how it might affect the New York case, according to the letter obtained by The Associated Press.

The lawyers argue that the Supreme Court's decision upheld a position raised by the defense earlier in the case that prosecutors should have been barred from presenting certain evidence that they said constituted official presidential acts, according to the letter.

In previous court filings, Trump has claimed that he is immune from prosecution for alleged acts related to official duties while in office. His lawyers have not made that argument in the bribe case, but they have argued that some evidence, including Trump’s social media posts about his former lawyer Michael Cohen, comes from his time as president and should have been excluded from the trial because of immunity protections.

The Manhattan district attorney's office declined to comment Monday evening.

The Supreme Court ruled Monday for the first time that former presidents enjoy broad immunity from prosecution, extending the deadline in Washington's criminal case against the Republican ex-president, who is accused of plotting to overturn his 2020 election defeat.

Trump was convicted in New York on 34 counts of falsifying business records in what prosecutors said was an attempt to cover up a payment to a porn actor just before the 2016 presidential election. He is scheduled to be sentenced in the spending money case on July 11.

Merchan instituted a pretrial policy requiring both sides to send him a one-page letter summarizing their arguments before filing longer court documents. He said he did this to better manage the case so he wouldn't be inundated with voluminous documents.

In rejecting Trump's request to move the trial from New York state court to federal court last year, a federal judge ruled that the allegations at the center of the case concerned Trump's personal life and in no way reflected the color of the president's official duties.

AP correspondent Jennifer King reports that Donald Trump's lawyers want to exploit the recent Supreme Court decision to overturn his conviction in New York.

The evidence overwhelmingly suggests that this was a purely personal matter for the president, a cover-up of an embarrassing event, U.S. District Judge Alvin K. Hellerstein wrote in his decision.
