Judge delays Trump's sentencing in hush-money case until September

The judge in former President Donald Trump's Manhattan criminal trial for paying a hush money has delayed his sentencing until at least Sept. 18 as Trump seeks to overturn the conviction following a Supreme Court ruling that granted broad immunity protections to presidents.

What you need to know The judge in former President Donald Trump's criminal trial in Manhattan has delayed his sentencing until at least Sept. 18, as Trump seeks to have the conviction overturned after a Supreme Court ruling that granted broad immunity protections to presidents. In a letter filed Tuesday, prosecutors with the Manhattan district attorney's office said they would be open to delaying the July 11 sentencing. The decision came a day after Trump's lawyer asked the judge to postpone the trial while he weighs the high court's decision and how it might affect the New York case. There was no immediate comment from the Trump campaign or Manhattan prosecutors, who brought the case.

Judge Juan M. Merchan postponed the July 11 sentencing date after prosecutors in Manhattan District Attorney Alvin Braggs' office said earlier Tuesday that they would be open to a delay in filing a response to Trump's motions.

Merchan wrote that he would rule on Sept. 6 and that the next date in the case would be Sept. 18, if that is still necessary.

The delay means Trump won't be sentenced until after he is officially nominated at the Republican National Convention in Milwaukee, which begins July 15. But it leaves open the possibility that he could face prison time during a critical period in his campaign. The second presidential debate is scheduled for September 10.

The Trump campaign and Manhattan prosecutors, who brought the case, had no immediate comment.

The decision came a day after Trump's lawyer asked the judge to postpone sentencing while he weighs the high court's ruling and how it might influence the New York case.

The Trump team argues that the Supreme Court ruling confirmed that prosecutors should have been barred from presenting certain evidence that its lawyers consider to be official presidential acts, according to the letter.

In their response, prosecutors said they believed those arguments were without merit, but noted they were not opposed to adjourning sentencing while the judge considers the matter.

Trump was convicted on May 30 of 34 counts of falsifying business records stemming from what prosecutors said was an attempt to conceal a $130,000 cash payment to porn star Stormy Daniels just before the 2016 presidential election.

Daniels claims she had a sexual relationship with Trump in 2006 after meeting him at a celebrity golf tournament in Lake Tahoe. Trump has repeatedly denied the claim, saying during his June 27 debate with President Joe Biden, “I have not had sex with a porn star.”

Prosecutors said Daniels’ payment was part of a larger scheme to buy the silence of people who might have publicly revealed embarrassing stories during the campaign that he had extramarital sex. Trump’s former lawyer, Michael Cohen, paid Daniels and was later reimbursed by Trump, whose firm recorded the reimbursements as legal fees.

Falsifying business records carries a possible sentence of up to four years in prison. Other possible penalties include probation, a fine or parole, which would require Trump to stay out of trouble to avoid further punishment. Trump is the first former president to be convicted of a crime.

Trump will have to be present in Mercans Court in Manhattan when he is sentenced.

The delay caps a series of political and legal victories Trump has won in recent days, including the Supreme Court's ruling on immunity and a debate widely seen as a disaster for Democratic President Joe Biden.

The immunity ruling all but closes the door on Trump being tried in his 2020 election interference case in Washington before the November vote. The timing itself is a victory for the former president, who has sought to delay his four criminal cases until after the election.

An appeals court recently stayed another election interference case against Trump in Georgia; no trial date has been set. His classified federal documents case in Florida remains mired in pretrial disputes that resulted in an indefinite cancellation of the trial date.

Monday's Supreme Court ruling granted broad immunity protections to presidents, while barring prosecutors from citing official acts as evidence to try to prove that a president's unofficial actions violated the law.
