Trump's sentencing for paying bribes has been postponed – Business Insider

Manhattan prosecutors agreed Tuesday to delay Donald Trump's sentencing on the bribe charge, saying they needed time to fight his efforts to overturn his conviction following Monday's Supreme Court ruling on immunity.

New York Supreme Court Justice Juan Merchan quickly agreed to postpone sentencing until September 18, but only if Trump's conviction survived this latest challenge.

“The matter is adjourned until September 18, 2024, at 10:00 a.m., for sentencing, if still necessary, or other proceedings,” Merchan wrote.

“While we find the defendant's arguments without merit, we do not oppose his request for leave to file” a challenge to the May 30 conviction, prosecutors wrote earlier Tuesday in a letter to Merchan.

The defense asked Merchan for permission to file a formal challenge to his conviction by July 10, just one day before Trump's original sentencing date of July 11.

Trump is expected to be formally nominated as the Republican presidential nominee at the Republican National Convention, which begins July 15, an event that would have been marred by his conviction four days earlier.

Prosecutors say it will take weeks to overcome this final hurdle.

“We respectfully request a deadline of July 24, 2024, two weeks after the deadline requested by Defendant to file and serve a response” to Trump’s arguments, prosecutors wrote to Merchan on Tuesday.

Merchan agreed to a July 10 deadline for the defense to file its challenge to Trump's conviction and a July 24 deadline for prosecutors to file their response.

The judge said he would issue a written decision on September 6 on whether the case should be retried.

How Trump plans to challenge his corruption conviction

Trump is challenging his corruption conviction a day after the Supreme Court ruled 6-3 that former presidents have broad immunity from criminal prosecution.

The landmark decision established that presidents are presumed immune from prosecution for “official acts.”

But the ruling goes further, saying that a former president's official acts cannot be used against him, even in otherwise legal criminal proceedings.

Trump sees the move as a possible way to escape conviction on 34 counts of falsifying business records to conceal a hush-money payment he made to a porn star in the month before the 2016 election.

The Supreme Court's decision Monday “affirmed the defense's position that DANY should not have been allowed to present evidence at trial of President Trump's official acts,” Todd Blanche, Trump's lead defense attorney, wrote to the judge in a letter released Tuesday.

“Due to the complexity of the issues presented, President Trump does not object to an adjournment of the July 11, 2024 sentencing date to allow sufficient time for a full briefing, oral argument, and decision,” Blanche wrote.

In March, Trump's team raised the issue of Supreme Court immunity with Merchan in an unsuccessful attempt to delay the trial or prevent any evidence implicating official acts.

“In this case, we objected to anticipated testimony from certain potential witnesses, evidence of President Trump’s social media posts and public statements, and a 2018 filing with the Office of Government Ethics,” Blanche wrote.
