A difficult path awaits Imran Khan despite two consecutive legal measures

 


Islamabad/Lahore: Despite the judicial relief measures taken in favour of Imran Khan, the former Pakistani prime minister's woes are far from over and he remained in jail on Sunday as authorities slapped new charges against him, including terrorism.

A district and sessions court on Saturday quashed the conviction of Khan, 71, and his wife Bushra Bibi, 49, in the un-Islamic marriage case related to violation of the mandatory waiting period for a Muslim woman between marriages.

The relief comes a day after the Supreme Court said in a key judgment that his party, Pakistan Tehreek-e-Insaf (PTI), was eligible to contest seats reserved for women and minorities in the national assembly and four provincial assemblies.

PTI will become the largest party in the National Assembly with 109 seats after the Supreme Court ruling.

Khan's two successive victories were interpreted as some kind of change of attitude by the powerful towards the PTI and its founder, but subsequent developments belie any such possibility.

The court ruled in the Iddat case that Khan and his wife should be released if they were not to be detained in another case and in anticipation of his release, a large number of PTI supporters accompanied by key leaders reached Adiala Jail in Rawalpindi, where they were detained, to welcome them.

But the PTI fears countermeasures from the government and has announced that Khan will be arrested in three cases related to the May 9 violence.

Soon, the cricketer-turned-politician was arrested by Pakistan's Punjab police in 12 fresh terror cases linked to the May 9 riots that erupted after his arrest in a corruption case last year.

“A team of Punjab Police on Sunday visited Adiala Jail in Rawalpindi and arrested PTI founder Imran Khan in 12 terror cases registered mainly in Lahore against him, including the attack on a military officer's house,” a senior Punjab Police official told PTI on Sunday.

He said police would seek Khan's remand before an anti-terrorism court in Lahore on Monday and added that all 12 cases were linked to the May 9 riots.

Last week, the Lahore court rejected Khan's bail plea in three cases related to the May 9 riots and allowed police to detain him for questioning. Khan has been charged with aiding and abetting the attack on the Lahore Corps Commander's house, known as Jinnah House, Askari Tower and Shadman police station on May 9.

In another setback earlier Sunday, a court handed over the former prime minister and his wife to the country's anti-corruption authorities for eight days of pretrial detention to investigate a new alleged corruption case.

The former first couple, taken into custody by the National Accountability Bureau (NAB) in a fresh corruption case in Toshakhana, were produced before Justice Muhammad Ali Warraich of the accountability court on Sunday.

NAB Deputy Director Mohsin Haroon, who led the team that arrested them, sought their remand and the court, after hearing the lawyers, agreed to grant them eight days of judicial remand. The court then ordered that the two men be produced before the court on July 22. They will remain in the high-security Adiala Jail during this period.

The period of pre-trial detention may be extended up to a maximum of 40 days at the request of the NAB if necessary to investigate the suspects.

With courts operating under rules, it is not easy for Khan's legal team to secure his release.

During their tenure, Khan and Bushra allegedly obtained gifts from the gift depot at low prices and sold them at higher prices.

This is the third Toshakhana case against Khan. His sentence in the previous two Toshakhana cases had been suspended by the Islamabad High Court.

The new case alleges the couple obtained valuable watches and other gifts from the state depository in violation of rules.

Khan has faced a series of cases against him since he was ousted from power in April 2022 after falling out with the establishment, seen as instrumental in his rise to power.

Despite dozens of lawsuits against him and several party leaders, he has stuck to his rhetoric of attacking senior military leaders and his supporters, spouting half-baked anti-establishment stories on social media.

This month, after a key meeting, the military labeled the social media attack digital terrorism, calling it unwarranted criticism by some quarters.

Army commanders said the politically motivated digital terrorism assault, unleashed by conspirators, duly encouraged by their foreign cohorts against state institutions, is aimed at causing despondency in the nation and sowing discord through blatant lies, fake news and propaganda.

The forum affirmed that the military leadership is aware of the overall challenges and is determined to discharge its constitutional responsibilities with the support of the resilient people of Pakistan.

Khan, for his part, took advantage of the media presence during the hearings against him in Adiala jail to fire salvos at his rivals, thus showing his unwavering determination to fight. He also reiterated that he must not spare his tormentors.

His own X account is active, apparently used by someone on his behalf, and he charges his opponents in the military and civilians with unwavering commitment. The same attitude has been displayed by his party leaders, who often compete with each other to spit more fire than the others.

All this added to his difficulties, despite the regular help he received from the courts.

The tortuous legal battle is becoming increasingly complicated by official opposition to his release from prison.

Recently, Prime Minister Shehbaz Sharif's political advisor Rana Sanaullah reportedly said that new cases would be filed against Khan in the coming days.

Speaking to reporters in Lahore on June 15, Planning Minister Ahsan Iqbal said Khan's detention for the next five years was necessary to bring economic stability.

People come to us and say that if Pakistan wants to progress, Imran Khan will have to be kept in jail for five years, he said.
