IHC to hear Imran Khan's petition against possible military detention today

SLAMABAD: The Islamabad High Court (IHC) has scheduled a hearing on a petition filed by Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan seeking to restrain his transfer to military custody.

The court registrar's office fixed the date for hearing of the petition despite objections, with Justice Miangul Hassan Aurangzeb presiding over the matter on Thursday (today).

Imran Khan had filed the petition expressing concerns over a possible trial in a military court for the May 9 cases. The PTI founder argued that the Pakistan Army had already arrested a retired officer (General Faiz Hameed), who could testify against him, raising the possibility of a trial under military law.

Khan's legal team has urged the court to ensure that he remains under the jurisdiction of civilian courts and is not handed over to the military. The petition names the federal government, the interior and defence ministries, Islamabad and Punjab police and Adiala jail authorities as respondents.

Rumors of Khan being transferred to military custody have been circulating, with some observers speculating that the former prime minister could face a court martial. The petition also highlights media reports of a possible military trial.

In a recent press conference, Lt Gen Ahmed Sharif Chaudhry, DG ISPR, responded to these concerns by saying, “The matter is sub judice, but military law will take its course if anyone uses individuals under the purview of the Army Act for personal gain.” Observers believe that these remarks were a reference to Imran Khan’s possible involvement in the ongoing proceedings before a military court.

The case also involves former ISI chief Lt Gen (retd) Faiz Hameed, who faces multiple charges including abuse of authority and collusion with a political party. Khan has expressed fears of being implicated in these prosecutions, especially after Faiz's arrest.

The military has said it has no political agenda, with General Sharif stressing that the Pakistani military operates in accordance with the constitution, in collaboration with the elected government.
