Court rejects bail pleas of Imran Khan and Bushra Bibi in New Toshakhana case

RAWALPINDI: A court on Monday rejected petitions filed by Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife and former first lady Bushra Bibi seeking bail in the new Toshakhana case in which they are facing allegations of abuse of power to acquire state gifts.

During the hearing at Adiala jail, where the former prime minister and first lady also appeared, special judge Central Shahrukh Arjumand announced the verdict on the bail pleas filed by the couple.

Today's development comes as the duo is expected to be charged in the said case on October 2 after the National Accountability Bureau (NAB) was restrained from pursuing the case and the case was transferred to the Federal Investigation Agency (FIA), as per the Supreme Court. The deposed prime minister was jailed for almost a year following his conviction in four cases, two Toshakhana references, the encryption case and the Iddat case, in which his wife is also incarcerated.

The new Toshakhana reference against the couple emerged after the NAB arrested them soon after a district and sessions court in Islamabad acquitted Khan and Bushra in the iddat case also known as non-Islamic nikah affair.

During today's hearing, the FIA ​​prosecutor said the suspects received the Bulgari (Bvlgari) jewelry set from Saudi Arabia and informed the court that the agency obtained from the Ministry of Foreign Affairs records a necklace and earrings.

“According to the files, the two objects are valued at Rs71.5 million,” said the prosecutor, adding that the couple had it valued at Rs5.8 million with a private company.

Asking the court to reject the couple's bail application, he further said that the suspects also failed to submit the said jewelry in the Toshakhana repository, a department under the administrative control of the Cabinet Division which stores the valuable gifts given to leaders, parliamentarians, bureaucrats and officials by heads of other governments and states and by foreign dignitaries as a gesture of goodwill.

Representing PTI founder and former first lady, lawyer Salman Safdar argued that the new Toshakhana case was similar to the previous one with similar allegations and approvers.

Referring to the SC's September 6 verdict reinstating the NAB amendments, the lawyer said Toshakhana's case against his clients should end following the top court's decision.

The court then reserved its verdict, then announced it after a break in the hearing.

Jewelry box

The jewelry set comprising a ring, bracelet, necklace and a pair of earrings was gifted to the former first lady during her visit to Saudi Arabia in May 2021, according to the NAB reference.

It says the PTI founder and his wife illegally kept the jewelry set.

He added that the deputy military secretary had asked the Toshakhana section officer to estimate and declare the price of the jewelry set.

The set of jewelry, he clarified, was not left in Toshakhana.

The jewelry company sold the necklace for 300,000 and the earrings for 80,000 on May 25, 2018. Information regarding the price of the bracelet and ring could not be obtained from the company.

On May 28, 2021, the price of the set was estimated at Rs70.56 million; the price of the necklace was Rs50.64 million and the price of the earrings included in the jewelry was then estimated at Rs10.50 million.

According to the rules, the price of 50% of the jewelry set is around Rs30.57 million.

The national exchequer suffered a loss of around Rs30.28 after the jewelry was undervalued.

According to the reference, the PTI founder and his wife violated the NAB order. He added that an investigation was initiated against the former first couple on the instructions of the NAB Chairman on August 1, 2022.
