Judge allows release of redacted evidence in Trump's federal election filing

A federal judge on Thursday approved the release of redacted evidence against Donald Trump that supports a brief unsealed this month in his federal election filing, but gave the former president seven days to try to block the disclosure.

In her order, U.S. District Court Judge Tanya Chutkan, who is overseeing the case, said prosecutors suggested the redactions to the brief's appendix were appropriate and that the defendants' general objections to further unsealing seals were unfounded.

Trump's lawyers had objected to “further disclosures” of any part of an annex, which accompanied a brief 165-page document from special counsel Jack Smith's team that was unsealed this month, as early voting for the presidential election begins.

Prosecutors had previously argued that the annex should be made public with proposals for its deletion.

Trump's lawyers had requested in their opposition that the court suspend any decision to release the documents to allow Trump to evaluate litigation options related to the decision.

As of Thursday evening, a lawyer for Trump did not immediately respond to a request for comment on whether his legal team planned to take further steps to block the disclosure.

Prosecutors from Smith's office had alleged in their brief that Trump “resorted to crimes” to stay in office after his election defeat four years ago and argued that his actions then did not involve official conduct as supported the Trump team.

The special counsels office declined to comment.

They had previously rejected claims by Trump's lawyers that the government was “motivated by inappropriate political considerations.”

“The Special Counsel's mandate is to uphold the law. They have no role or interest in partisan politics and have faithfully performed their prosecutorial duties in this matter,” they wrote in an Oct. 1 filing.

Trump and his lawyers have repeatedly tried to delay legal proceedings related to the indictments he faces until after next month's election.

The federal election case was overturned after the Supreme Court's immunity ruling, which held that Trump has some protection from prosecution related to official acts. No trial date has been set.

Trump's Georgia indictment, which is also linked to efforts to overturn the 2020 election results, also won't go to trial until November. The judge in the case dismissed three of the original 41 charges last month, including two against Trump.

Separately, Trump managed to postpone sentencing in his hush money case in New York. The judge in the case last month granted his request to further delay his sentencing hearing until after Election Day. A jury in the secret trial had found Trump guilty of 34 counts of falsifying business records in connection with a payment to an adult film star before the 2016 presidential election.

Sentencing, now set for November 26, has been delayed several times from the original date of July 11.
