IHC orders Imran Khan to be produced in court today

ISLAMABAD: The Islamabad High Court (IHC) on Thursday ordered the superintendent of Adiala Jail to produce Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan, who is behind bars, before the court today today at 3 p.m.

“Bring PTI founder, he will have a meeting with his lawyers,” IHC said while hearing a contempt of court case against Adiala prison superintendent for not allowing lawyers to meet the former Prime Minister.

This development comes as the imprisoned politician has been behind bars at the Adiala facility for over a year due to a plethora of court cases of which only one remains, namely the New Toshakhana case relating to an alleged illegal sale of state gifts. .

Khan and his wife Bushra Bibi were arrested in the said case soon after their acquittal in the iddat case, also known as the un-Islamic nikah case.

The incarcerated former prime minister had appeared before the Supreme Court via video link in the National Accountability Bureau (NAB) amendments case in May.

The IHC orders come in the backdrop of the party's strenuous efforts to secure the release of its founder.

Apart from PTI's demand to release Khan, over 60 members of the US House of Representatives have also written a letter to President Joe Biden demanding the release of the ex-prime minister.

In their letter, the Democratic lawmakers urged President Biden to prioritize human rights in U.S. policy toward Pakistan.

“We write to you today to urge you to use the United States' considerable influence with the Pakistani government to secure the release of political prisoners, including former Prime Minister Khan, and end widespread human rights abuses. 'man,' the lawmakers said.

During today's hearing, Justice Sardar Ejaz Ishaq Khan said the Adiala superintendent will have to show reasons if he fails to secure Khan's presence in court.

“The court does not accept security threats […] lawyers were not allowed to assemble, this is contempt of court,” Justice Ishaq remarked while ordering the prison official to provide the Interior Ministry report and explain what were the specific threats.

The judge also said that reasons will have to be given and the court will have to be convinced of the exact threats that existed if the PTI founder was not produced before the court.

During the proceedings filed by lawyer Faisal Chaudhry, the petitioner's lawyer said that Khan's lawyers have not been able to meet him since October 3.

“If we go to prison, are there any threats to our safety?” » he questioned.

In response, the state prosecutor informed the court that the Punjab government had banned meetings inside the jail due to concerns over the law and order situation.

“Is there any ban on lawyers meeting him? If the Punjab government had banned lawyers from meeting, it would have committed contempt of court; whoever issued this notice has also committed contempt of court,” the court noted.

In response to the Additional Attorney General's objection to the court's initial directions ordering the superintendent of Adiala Prison to facilitate a meeting between Khan and his lawyer via video link, the court subsequently ordered authorities to produce the founder of the PTI in court.

The court also summoned the Joint Secretary of the Home Ministry with relevant documents and issued a notice to the Attorney General's Office to assist the court.
