SC rejects petition to shift Imran Khan to Khyber Pakhtunkhwa

ISLAMABAD – Discouraging unnecessary litigation and dragging the judiciary into politics, the Supreme Court has rejected a petition seeking to move the PTI founder from Adiala jail in Khyber Pakhtunkhwa and imposed a fine of Rs 20,000 on the petitioner.

The seven-member Constitutional Bench of the Supreme Court of Pakistan (SCP), headed by Justice Amin-ud-Din Khan, was hearing the petition in the principal bench on Tuesday. Other members of the bench included Justice Jamal Khan Mandokhail, Justice Naeem Akhtar Afghan, Justice Hasan Azhar Rizvi, Justice Musarrat Hilali, Justice Muhammad Ali Mazhar and Justice Shahid Bilal Hasan. The Court termed the petition as unnecessary and irrelevant and imposed a fine of Rs 20,000 on the petitioner, Mr. Abdul Qayum Khan, an ordinary citizen.

The petitioner argued before the court that he had brought his petition to the Supreme Court in greater national interest. Justice Amin-ud-Din Khan remarked that “you have nothing to do with this matter”. Justice Jamal Mandokhail advised the petitioner to go to Parliament and serve the nation as a policy maker. Justice Musarrat Hilali addressed the petitioner and said, “See you soon.”

An Anti-Terrorism Court (ATC) on Tuesday rejected the request for fresh physical detention of 146 PTI activists and sent the accused to jail on judicial remand in the D-Chowk protest and riot case.

ATC judge Tahir Abbas Sapra heard the case in which 146 PTI workers were produced before the court after their ten-day remand ended.

During the hearing, the police requested the court to grant another 20 days of remand to the accused. The defense attorney opposed the request and said a fourteen-year-old boy was also incarcerated in the same case and nothing had been recovered from his custody.

The judge noted that footage of all the incidents is available even though children were not present among the protesters. The defense lawyer said the accused were produced after 11 days, adding that they were all laborers. The court subsequently rejected the request for remand and remanded the accused to judicial custody.

Meanwhile, an Anti-Terrorism Court (ATC) on Tuesday extended the judicial custody of 54 PTI activists by two days to complete identification proceedings in a case registered by Khanna police station. ATC Judge Tahir Abbas Sapra heard the case. However, the accused could not be produced before the court and the police requested the court to grant three days' additional remand to the accused.

The judge said the court allowed only two days to complete the proceedings and asked the police to summon the accused for the next hearing. The judge noted that the High Court said the identification process should be completed within three days, but the prosecution demands three more days. The court extended the remand and adjourned the case.
