Daniel Penny, the former U.S. Marine recently acquitted of murdering New York City subway passenger Jordan Neely, spent Saturday rubbing shoulders with President-elect Donald Trump and Vice President-elect JD Vance at the annual football game between the Army and Navy in Maryland. .

The homeless black street artist's death sparked outrage and calls for justice for homeless New Yorkers, while Penny and some witnesses aboard the train claimed he posed a danger to others on board. The former Marine held Neely in a deadly chokehold for more than six minutes.

He was just threatening to kill people, Penny told Fox News host Jeanine Pirro. He threatened to go to prison forever, to go to prison for the rest of his life.

Penny emerged as a heroic figure among Republican officials and in right-wing media. After his acquittal, Vance invited him to the Army-Navy game.

Daniels is a good guy, and the New York mob prosecutor tried to ruin his life because he had a backbone, Vance wrote on X earlier this week. I am grateful that he accepted my invitation and I hope he can have fun and appreciate how much his fellow citizens admire his courage.

On May 1, 2023, Penny placed Neely in a chokehold for nearly six minutes, continuing even as train passengers disembarked and Neely became immobile.

Passengers were alarmed when Neely allegedly began shouting on the train that he needed food, water, shelter, a job and that he was ready to die. He also allegedly threw trash at passengers.

The city medical examiner's office concluded that Penny's strangulation killed Neely due to neck compression.

After Neely's death, Penny was charged with manslaughter and negligent homicide.

Prosecutors dropped a more serious manslaughter case after a Manhattan jury deadlocked on a verdict.

On December 9, he was acquitted of the final charge of criminally negligent homicide.

Both charges were misdemeanors punishable by prison time.

During her trial, a GiveSendGo fundraiser for Penny's legal defense became the second most successful campaign in the site's history, raising more than $3 million, largely due to support from the right.

Meanwhile, protesters across New York City have held events demanding justice for Neely's death.

Neely's family has since filed a wrongful death lawsuit, accusing Penny of negligent touching, assault and battery that caused injury and ultimately death.

Neely, who had previously worked as a street performer and Michael Jackson impersonator, had a history of homelessness and schizophrenia. He had previously been accused of assaulting people in subway stations, but he had not touched anyone on the day of his death.

Penny joined several other new Trump administration officials and prominent Republicans in the presidents-elect's suite.
