ABC settles Donald Trump defamation lawsuit with $15 million

NEW YORK CITY –

ABC News has agreed to pay Donald Trump's US presidential library $15 million to settle a lawsuit over anchor George Stephanopoulos' inaccurate on-air claim that the president-elect was found civilly liable for raping the writer E. Jean Carroll.

According to settlement documents made public Saturday, ABC will also post a notice on its website expressing regret over the claim in a March 10 segment of the show “Stephanopoulos This Week” and pay $1 million in legal fees to the Trump's lawyer.

In a statement, ABC News said: “We are pleased that the parties have reached an agreement to dismiss the lawsuit under the terms of the court filing.

Trump sued Stephanopoulos and ABC for defamation days after the anchor claimed during an interview with Rep. Nancy Mace, R-S.C., that Trump had been found responsible for rape, “which misrepresented the verdicts in both trials of Carroll against him.

Last year, Trump was convicted of sexual assault and defamation against Carroll and was ordered to pay him $5 million. In January, he was found liable in new defamation suits and ordered to pay Carroll $83.3 million. Trump is appealing both verdicts.

Neither verdict involved a finding of rape as defined by New York law.

The judge in both cases, Lewis Kaplan, said the jury's conclusion was that Carroll failed to prove that Trump violated her in the narrow, technical sense of a particular section of New York criminal law .

Kaplan noted that the definition of rape was much narrower than the definition of rape in common modern parlance, in some dictionaries, in some federal and state criminal laws and elsewhere.

The judge said the verdict did not mean that Carroll failed to prove that Mr. Trump raped her, because many people generally understand the word rape. Indeed… the jury concluded that Mr. Trump had indeed done just that.
