Trump can still vote after conviction, but cannot own a gun

NEW YORK (AP) President-elect Donald Trump does not need to go to jail, pay a fine or perform community service following his hush money conviction in New York. A judge ended the case Friday with a sentence of absolute discharge, closing the case without punishment.

But unless the conviction for falsifying business records is one day overturned, Trump will have crimes on his record that will affect some of his rights.

Here are some of the potential impacts and some things that won't change:

Can he still vote?

Trump is registered to vote in Florida and will be able to vote there.

Florida bars people convicted of felonies from voting, but restores their right to vote once they have served their sentences. People convicted of murder or sexual offenses permanently lose their right to vote unless their rights are restored by a pardon board.

For people convicted of crimes in other states like Trump, Florida only makes a person ineligible to vote if they lost their right to vote in the state where they were convicted. New York does not allow a person convicted of a crime to vote while incarcerated, but restores the right to vote once that person is released.

Can he own a gun?

No. Under federal law, people convicted of felonies are not allowed to possess firearms.

Should he give a DNA sample?

By law, anyone convicted of a crime in New York must provide a DNA sample to the state's criminal data bank.

Samples are collected after sentencing, usually when a defendant reports to probation, jail, or prison. Samples may also be taken by a court or police officer.

This is a non-invasive process involving a swab along the inside of the cheek. The state police analyze the cells and genetic material and create a profile which is then stored in the database.

There, technology takes over, performing automatic searches and comparing the profiles of people convicted of crimes with DNA profiles collected at crime scenes. Matches can be used to identify a suspect in an unsolved crime.

The New York database contains profiles of more than 720,000 offenders and is connected to the FBI's Combined DNA Index System.

Can Trump hold office with a felony conviction?

Nothing in federal law prevents a person from becoming president because they have been convicted of a crime. State laws vary on whether a person with a criminal record can run for state and local office. Some need a pardon or expungement to run for office. There are no such limits for running in federal elections.

Can he travel outside the United States?

Yes. As president, Trump will have a diplomatic passport allowing him to travel abroad for official business and will also be able to maintain a regular or tourist passport. People sentenced to incarceration or probation can have their passports denied or revoked, but that is not the case for Trump.

Some countries restrict or reserve the right to prohibit visits to people convicted of crimes, including Canada, the United Kingdom and Israel.

Will this eliminate business opportunities?

Trump's felony conviction could prohibit him from holding a liquor license, but that doesn't necessarily mean his golf courses and hotels will have to stop serving alcohol.

In New Jersey, for example, where Trump owns three golf courses, state law prohibits anyone convicted of a crime involving moral turpitude from holding a liquor license.

But Trump's company said his properties were all owned by corporations and that he was not an officer or director of any entity with a liquor license.

Trump's conviction could also bar him from re-entering the casino business, if he so chooses, because people with criminal records are generally unable to obtain a gaming license. Trump once owned three casinos in Atlantic City , in New Jersey, but that is no longer the case.

Can Trump get a pardon?

Only the governor of New York has the authority to pardon Trump for this conviction. The Trump case was tried in state court and involved violations of state law. Presidential pardons only apply to federal crimes.

It appears unlikely that Gov. Kathy Hochul, a Democrat, will pardon Trump. When asked last month whether she would consider pardoning Trump, she said neither yes nor no, but noted that the pardon process requires several elements, including remorse.

Trump says he did nothing wrong and has described the accusations against him as a hoax perpetrated by Democrats.
