Trump says he will issue executive order delaying US ban on TikTok on Monday
The law, which the Supreme Court unanimously upheld Friday, leaves the interpretation of a conditional surrender to the president. In his latest post, Trump seemed to lay out what would satisfy that definition for him.
Trump said he would like the United States to have a 50% stake in a joint venture and confirmed the move would save TikTok. Trump's transition team did not immediately respond to a request for clarification on whether it believed the property should be held by a U.S.-based company or by the U.S. government itself.
Despite this, ByteDance never indicated that TikTok was actually for sale and never revealed a valuation. Given that the company is reluctant to sell, a 50% joint venture might be more acceptable than losing 100% ownership of TikTok.
A qualified assignment would give TikToks service providers much more peace of mind than just an extended period of non-enforcement.
Trump's message on Truth Social on Sunday also appeared to contradict what House Speaker Mike Johnson, R-La., said earlier Sunday when he told NBC News Meet the Press that he thought the Trump's intention was to try to impose a real surrender, by changing. hands, ownership, before TikTok is allowed online again in the United States.
I think we will apply the law, he said.
Rep. Jim Jordan, Republican of Ohio, echoed Johnson in an interview on CNN's “State of the Union” but said he felt comfortable with a 90-day extension .
“It seems to me that if you do something without someone else buying TikTok and ByteDance no longer owning it, you're going to have to change the law. And if that's what's justified, then I think Congress will review this with President Trump's leadership, he said.
“How this will be resolved, I guess, is open to different scenarios. But right now, the law is the law, and of course you hold these companies to follow the law,” he added.
Also Sunday, Rep. Mike Waltz, Republican of Florida, Trump's new national security adviser, told CNN that Trump's intention was to communicate with the various stakeholders, get him back in line and make him win time to save the application.
It's about giving tech companies, app stores, vendors, cloud storage and others confidence that we're going to work towards some sort of agreement so this doesn't get dark. And I think that's what you're going to see in the next 24 hours, Waltz said.
He added: We're working, literally in real time, with the different tech companies to get it back online and purchased. [Trump] some time to, firstly, safeguard them, but protect Americans' data and protect Americans from any type of foreign interference.
Trump initially requested additional time from the Supreme Court last month, when he filed an amicus brief in the TikTok case against the ban.
In his brief, he urged the Supreme Court to suspend the ban, which took effect a day before his inauguration, so he could work with the app to explore ways to keep it legally online in the United States.
The court upheld the law Friday, rejecting TikTok's challenge and Trump's plea.
Following the court's ruling, White House Secretary Karine Jean-Pierre said in a statement: “Given the simple fact of timing, this administration recognizes that steps to implement the law must simply be up to to the next administration, which will take office on Monday. »
Yet those assurances weren't initially enough for TikTok, which said late Friday that it would still respect the ban.
Trump's support for TikTok represents an almost complete reversal from his stance during his first term, when he pledged to ban it.
“As far as TikTok is concerned, we ban them from entering the United States,” he told reporters in July 2020. “I can do it with an executive order or something else.
On August 6, 2020, Trump signed an executive order to ban TikTok after 45 days. The order faced legal challenges, and TikTok obtained an injunction against it in late September of that year. When President Joe Biden took office four months later, he rescinded the executive order.
The anti-TikTok rhetoric came after months of lawmakers on both sides sharing concerns about privacy and national security related to the app. And in December of the previous year, the Army and Navy banned their members from using TikTok on their government-owned devices.
In 2022, House staffers and lawmakers were also barred from using TikTok on their government-issued devices. And just weeks before, the Senate voted to ban all federal employees from using it on their government-owned devices.
In an interview with CNBC last March, Trump downplayed concerns about the threats TikTok poses to national security because of its ties to China, saying American social media companies pose the same risks.
“We also have this problem with others, you also have this problem with Facebook and a lot of other companies. I mean the information, they get a lot of information, they deal with China and they do everything that China wants,” Trump said.
“You know, if you look at some of our American companies, when you talk about highly sophisticated companies that you think are American, they're not. They're doing business in China, and in China, if China wants something of them, they will give it, so it is also a national security risk,” he added.
