Trump's executive order on biological truth is not true
For most Americans, the past few days have been like a whirlwind; For intersex Americans like me, the past week has been one of unimaginable whiplash. On January 16, then-President Biden's Department of Health and Human Services (HHS) released a groundbreaking report on the health inequities facing our community, considered the first-ever federal policy recognizing the existence, not to mention the challenges facing intersex people around the world. UNITED STATES. Fast forward to January 20th and President Trump signed an executive order that attempts to deny our very existence.
Trump's executive order on Ideological Gender Extremism and Restoring Biological Truth to the Federal Government, designed as an attack on transgender Americans and disingenuously disguised as women's advocates, erases the biological reality of intersex people like me . I was born with physical traits, external sexual anatomy, internal reproductive organs, hormones, and chromosomes that don't perfectly match the binary male or female options on a birth certificate, and I'm not alone. As the largely data-based HHS report references, more than 5 million intersex Americans were born with differences or variations in their sex characteristics or reproductive anatomy, roughly the same number as those born with naturally red hair. Trump's executive order, however, states that it is the policy of the United States to recognize both sexes, male and female, and dictates that the sexes are not changeable, but rather anchored in a fundamental and indisputable reality.
Unfortunately for Trump, the reality of intersex Americans like me is increasingly visible. However, the fact that you may have just learned the word intersex yourself is probably because we often undergo non-consensual gender normalization surgeries that attempt to hide our God-given traits from a society more comfortable with binary boxes, such as the only options available on most birth certificates. This is demonstrated in the groundbreaking UN resolution on intersex rights which was announced in April last year and which reaffirms that medically unnecessary surgeries performed without consent violate our rights, as several surgeons have long corroborated American generals and the World Health Organization (WHO). The same day Trump issued his gender binary executive order, he also ordered the United States to withdraw from the WHO.
Despite the invisibility of intersex people in broader society, our unquestionable existence demonstrates that Trump's order is based neither in reality nor in biology. Contrary to current medical doctrine and millennia-old literary references, the new decree makes numerous false assertions that contribute to our erasure, one of which directly concerns my own lived experience. “Female” means a person belonging, at the time of conception, to the sex that produces the large reproductive cell, Trump's executive order reads. I was born with internal testicles and an external vagina. I have XY chromosomes and my birth certificate still says Female. I never produced the “large reproductive cell” and only produced the “small reproductive cell” until I was sterilized without my consent as an infant, in order to adapt my body to this sexual binary scientifically erroneous that the decree seeks to falsify into law.
A later clause also mandates a tax-funded effort to update our personnel records to force adjustment of this invalid item. So my question to the President is this: When you tell me to adopt documentation that “accurately reflects the gender of the incumbent,” what should it say on mine?

It took decades for the powers that govern our country to recognize us as the citizens that we are and the rights that should be granted to us. But less than a week after a president finally released a road map to help us achieve these rights, a new president is now claiming we're not real.
The clearest path forward is for our community to share our stories in our own voices and for the public to commit to witnessing and believing them. While Trump's order attempts to prevent the public from acknowledging our existence, intersex people are accustomed to dispelling the shadows to which we have been relegated with the undeniable light of our truth, biological or otherwise.
