Imran Khan and Bushra Bibi contest their conviction in the 190 million case

Former Imran Khan Prime Minister and his wife, Bushra Bibi, filed an appeal on Monday before the High Court of Islamabad (IHC) against their conviction in the Al-Qadir Trust case, worth 190 million pounds sterling.

Earlier this month, an Islamabad account court sentenced the president of Pakistan Tehreek-e-insaf (PTI) to 14 years in prison and his wife at the age of seven, as well as heavy fines. The verdict was rendered by judge Nasir Javed Rana, marking another legal blow for Khan, who has been in prison since August 2023.

The case revolves around 2019 allegations, during Khan's mandate as Prime Minister, according to which he and others have diverted 50 billion rupees (the equivalent of 190 million pounds sterling at the time) that the National Crime Agency (NCA) of the United Kingdom had sent to Pakistan.

The PTI firmly rejected the decision, describing it as politically motivated. The party announced its intention to challenge the decision to the higher courts. The appeal, filed by the legal advisers Salman Akram Raja and the lawyer Salman Safdar, argues that the court of first instance misinterpreted the evidence and ignored the crucial facts, making the convictions not very sure.

The advocacy also claims that condemnation is part of a political campaign, alleging that the NAB (National Accountability Bureau) has been used as a tool for political victimization. He stresses that Khan already faces more than 280 cases, many of which have resulted in acquittals.

According to the request, the accusation did not succeed in producing any witness to the United Kingdom or Pakistan to support its assertions. He also referred to a decision of the United Kingdom Court of Appeal which said that the funds in question were not crime products, thus calling into question the account of the accusation. In addition, the petition disputes the jurisdiction of the NAB in this case, quoting a decision of the Supreme Court which requires material evidence of a personal financial gain for such cases.

The petition also emphasized Khan's contributions to health care and education, denying the allegations of personal financial benefits from the Al-Qadir Trust. He criticized the precipitation of the trial and said that it had taken place under unjustified pressures, compromising justice.

The arrest of Khan on May 9, 2022 in the premises of the IHC was also disputed in the advocacy, because it would have violated article 24 of the NAB order of 1999.

This case marks the last of a series of judicial disputes for Khan, whose previous convictions were either suspended or canceled.
