Imran Khan holds the Supreme Court against the transfer of judges

Islamabad [Pakistan]March 14 (Ani): the former Pakistani Prime Minister Imran Khan filed a request to the Supreme Court, contesting the recent transfer to the judges, calling it “unconstitutional and illegal”, reported the Express Tribune. The petition, subject under article 184, paragraph 3, of the Constitution, argues that the notification of transfer violated the independence of the judiciary. The founder of Pakistan Tehreek-e-insaf (PTI), Imran Khan, urged the court to declare the null notification and not avenue. The federal government and the registrars of the high lessons of Lahore, Sindh, Balutchistan and Islamabad were mentioned as respondent in the case, reported the Express Tribune. According to legal experts, the case could test the point of view of the Supreme Court on judicial independence. Imran Khan's legal team declared that the decision could affect fair trial and judicial neutrality, urging the Supreme Court to intervene immediately. In February, the judges of the High Court of Islamabad (IHC) decided to challenge the rejection of their representation.
In the representation, the judges of the IHC asked for the restoration of the previous seniority structure of the IHC. They also asked for the cancellation of the decision published by the IHC chief judge, Aamer Farooq, who had rejected the representation. Game by chief judge Aamer Farooq had confirmed the placement of three judges transferred to the High Court of Islamabad from three other high courts, retaining their ranking in the second, ninth and 12th position in the list of anifiers. The five IHC judges challenged the new seniority list. The chief judge said that the transferred judges do not need to take an oath and that their seniority would be counted from the date of their first oath before the High Court. Consequently, the seniority list of IHC judges will remain unchanged. On February 1, the strength of the judges of the IHC increased with the transfer of judge Sarfaraz Dogar from the High Court of Lahore (LHC), judge Khadim Hussain Soomro of the High Court of the Sindh and the judge Muhammad Asif of the Balochistan High Court. Akhtar Kayani as the second oldest judge and judges Miangul Hassan Aurangzeb in third position. Until Tariq Jahangiri was in fourth place, judge Babar Sattar fifth, judge Sardar Ishaq Khan Sixth, judge Arbab Muhammad Tahir Seventh, judge Suman Riffat Imtiaz Highth, judge Soomro 10e, judge Muhammad Asif 11th and judge inam amin minhas 12th, in accordance with the report. After the seniority list, judge Kayani, judge Jahangiri, judge Sattar, judge Khan and judge Imtiaz submitted a representation to the chief judge asking him not to consider the Dogar judge as an IHC judge until he has taken oath as a LHC judge. However, it is already mentioned as the CIH judge in the IHC seniority list. They asked for the chief judge to resolve the case before the JCP meeting.
