ECP obtains time in the case of Imran against the trial in prison – Journal

Lahore: The High Court of Lahore (LHC) granted more time to the Pakistan Electoral Commission (ECP) to file an answer to a request from the founding president of the PTI, Imran Khan, contesting his trial in prison in a case of contempt for ECP.

A complete bench of three members, led by chief judge Aalia Neelum, resumed the hearing on the petition and an ECP lawyer explained the delay in submission of the response, saying that certain documents should be included in the case file. He asked for more time to provide the answer.

The bench expressed dissatisfaction with the non-no-submission of an ECP response but allowed its request and postponed the hearing.

Judge Shehram Sarwar Chaudhry and Judge Asjad Javaid Ghural were the other members of the bench.

Mr. Khan's petition argued that the ECP on November 30, 2023 had made the order sentenced to trial at Adiala prison due to unpertified security problems.

He pleaded that the ECP did not appreciate that a trial in prison would violate several fundamental rights of the petitioner, adding that the ECP had poorly argued that it could order a trial in secret and in prison. He argued that a trial in prison was a violation of article 10-A of the Constitution, which guarantees the right to fair trial and legality.

The petition asked the court to cancel the decision of the ECP and ask him to have an open and public trial with full access to his legal team, the media and the public.
