IHC orders an investigation into the refusal of the lawyer's access to Imran Khan
Islamabad [Pakistan]March 15 (Ani): The High Court of Islamabad (IHC) ordered an investigation into the refusal of a meeting between the former Prime Minister Imran Khan and his lawyer, Mashal Yousafzai, appointing the clerk of the Sakina Bangash court to investigate the possibility of illegally warning the meeting.
Dawn said that the directive came during a hearing on a request for trial against the court against the officials of Adiala prison for complying with the court orders.
Judge Sardar Ejaz Ishaq Khan, who chaired the hearing, ordered the prison authorities to facilitate Bangash's visit to determine the facts.
During the procedure, the prison administration said Khan had personally refused to meet Yousafzai when his name had been presented to him. However, this assertion was encountered by the skepticism of the Court, because the authorities had previously assured that the meeting would take place.
Mashal Yousafzai, who appeared before the court alongside his lawyer Shoaib Shaheen, argued that multiple petitions had been filed on the issue but were assigned to a different court, delaying the resolution. Meanwhile, the state lawyer presented a handwritten list, allegedly subject by Imran Khan himself, listing the lawyers he had refused to meet.
This statement has raised new concerns, because the court questioned its authenticity and if it precisely reflected Khan's intentions. Judge Khan expressed dissatisfaction concerning the non-compliance with the prison authorities to comply with the previous directives and stressed that the refusal of access despite clear judicial orders could be an outrage.
To resolve the case, the court ordered the officials of Adiala prison to ensure that Imran Khan was presented via a video link at 2 p.m. or if this was not possible, in person at 3 p.m., doing so, warned judge Khan, would cause legal action against the Islamabad police chief.
In addition, the court asked Khan to provide a written declaration confirming or denying if Mashal Yousafzai was his legal representative, responding to concerns concerning the legitimacy of his complaint.
When the hearing later resumed in the day, the superintendent of Adiala prison, Abdul Ghafoor Anjum, appeared in court and was asked about the delay in the facilitation of the meeting. He said he was outside the city and reiterated that Imran Khan refused to meet Yousafzai.
However, the court is not convinced, stressing the inconsistencies in the responses of the authorities and reaffirming its commitment to ensure regular procedure, Dawn reported.
Islamabad lawyer Ayaz Shaukat then informed the court that Khan's presentation via a video link was not possible due to security problems. In response, judge Khan ordered both the prison administration and the Inspector General of Islamabad to submit affidavits detailing their compliance with the directives of the court.
The clerk of the Sakina Bangash court was responsible for visiting Adiala prison to check if Imran Khan had indeed refused the meeting with Yousafzai. It should also assess whether the meetings of the former Prime Minister with other partners are organized in accordance with legal provisions.
A list of six lawyers, signed by Khan, was presented to the court, raising other questions about the validity of the proxy.
During the hearing, the prison administration informed the court that Khan, his wife Bushra Bibi and his legal team were to meet on Tuesday.
However, Yousafzai remained skeptical about the fairness of the process and wondered if justice would be done. In response, judge Khan reassured her that the court took the necessary measures to verify the facts and respect the rule of law.
The Court postponed the procedure until March 21, asking Bangash to finish the investigation and to present its conclusions at the next hearing.
In addition, the High Court of Lahore (LHC) granted the Pakistan Electoral Commission (ECP) on Friday to submit its response to Imran Khan's petition contesting its trial in prison in an outrageous case.
A bench of three members, led by chief judge Aalia Neelum, started to hear the petition again. The ECP lawyer cited the need to compile the necessary documents as a reason for the delay in submission. The bench expressed its dissatisfaction with the non-submission of the response but allowed the request, adjourning the hearing.
Khan's petition questions the decision of November 30, 2023 of the ECP to carry out its trial within the Adiala prison due to unpertified security problems. The petition argues that this decision violates several fundamental rights, in particular the right to a fair trial under article 10-A of the Constitution, Dawn reported.
Khan urged the court to cancel the decision of the ECP and the direct authorities to organize a public trial with full access for its legal team, its media and the public. (Ani)
