A proclamation

Tren de Aragua (ADD) is a foreign terrorist organization designated with thousands of members, many of whom illegally infiltrated the United States and waged an irregular war and undertake hostile actions against the United States. ADD operates jointly with Crtel de Los Soles, the narco-terrorism company sponsored by the regime of Nicolas Maduro, based in Venezuela, and commits brutal crimes, including murders, kidnappings, extensions and human trafficking, drugs and weapons. ADD is committed and continues to engage in an illegal mass migration in the United States to advance its objectives to harm American citizens, undermine public security and support the objective of the Maduro regime to destabilize democratic nations in the Americas, including the United States.

ADD is closely aligned, and has indeed infiltrated the Maduro regime, including its military apparatus and the application of the law. ADD has developed considerably while Tierck El Aissami was governor of Aragua between 2012 and 2017. In 2017, El Aissami was appointed Vice-President of Venezuela. Shortly after, the United States Department of the Treasury appointed El Aissami as a specially designated drug trafficker under the Kingpin's designation law of foreign narcotics, USC 1901 and following. El Aissami is currently fugitive accusations of the United States resulting from its violations of the American sanctions launched by its designation of the Ministry of the Treasury.

Like El Aissami, Nicolas Maduro, who claims to act as president of Venezuela and affirms control of the security forces and other authorities of Venezuela, also maintains the close ties with the narco-terrorists sponsored by the regime. Maduro directs the company sponsored by the Crtel regime of Los Soles, which coordinates with ADDD and other organizations to achieve its objective of using illegal narcotics such as a weapon to “flood” the United States. In 2020, Maduro and other members of the regime were charged with narcoterism and other crimes as part of this plot against America.

Over the years, the national Venezuelan local authorities have sold control of all territories on transnational criminal organizations, including ADD. The result is a hybrid criminal state that perpetuates an invasion and a predatory foray into the United States and which represents a substantial danger for the United States. Indeed, in December 2024, Interpol Washington confirmed: “Tren de Aragua appeared as an important threat to the United States because it infiltrates the migration flows of Venezuela.” The evidence irrefutably demonstrates that ADD has invaded the United States and continues to invade, try to invade and threaten to invade the country; Irregular war perpetrated in the country; And used drug trafficking as a weapon against our citizens.

On the basis of an examination of ADD activities, and in consultation with the Attorney General and the Secretary of the Treasury, on February 20, 2025, acting under authority in 8 USC 1189, the Secretary of State appointed ADD as a foreign terrorist organization.

As President of the United States and Commander-in-Chief, it is my solemn duty to protect the American people from the devastating effects of this invasion. Now, consequently, I, Donald J. Trump, President of the United States of America, by the authority left in me by the Constitution and the laws of the United States of America, including the Act respecting extraterrestrial enemies, 50 USC 21 and following, proclaim and direct yourself as follows:

Section 1. I think and declare that TDA perpetuates, tries and threatens an invasion or a predatory foray against the territory of the United States. ADD undertakes hostile actions and carried out an irregular war against the territory of the United States both directly and in the direction, underground or otherwise, of the Maduro regime in Venezuela. I do these results using the full extent of my authority to lead the country's foreign affairs under the Constitution. On the basis of these conclusions, and by the authority left in me by the Constitution and the laws of the United States of America, including 50 USC 21, I proclaim that all the Venezuelan citizens aged 14 or more who are ADD members, are in the United States, and are not really naturalized or legal as a foreign support in the United States. I also find and declare that all of these ADD members are, because of their membership of this organization, responsible for real hostility against the United States and are therefore not eligible for the advantages of 50 USC 22. I find and also declare that all these members of ADD are a danger to the peace or public security of the United States.

Second. 2. I ask the Attorney General, within 60 days of the date of this proclamation, to prepare and publish a letter under his signature declaring the policy described in section 1 of this proclamation as the United States policy and joining this proclamation. I ask the Attorney General to transmit this letter to the US judge in chief, the chief judge of each circuit court, the chief judge of each district and territorial court of the United States, each governor of a state and a territory of the United States and the highest judicial agent of each state and territory of the United States.

Second. 3. I say that all foreign enemies described in section 1 of this proclamation are subject to immediate apprehension, detention and abolition, and moreover, they will not be authorized in the United States.

Second. 4. In accordance with the Act respecting extraterrestrial enemies, the Attorney General and the Secretary of Internal Security must, in accordance with the applicable law, apprehend, retain, secure and withdraw each foreign enemy described in article 1 of this proclamation. The interior security secretary retains discretion to apprehend and withdraw any foreign enemy under any distinct authority.

Second. 5. All executive departments and agencies (agencies) must collaborate with managers of the application of the laws of the United States and with appropriate state officials, to use all legal means to apprehend, retain, secure and delete foreign enemies described in section 1 of this proclamation.

Second. 6. In accordance with my authority with less than 50 USC 21 to order that conduct be observed from the United States to foreign enemies subject to this proclamation, to direct the way and the degree of restraint to which these foreign enemies will be submitted and in which cases, to predict the revocation of these extraterrestrial enemies, and to establish any other security regulations to execute all the regulations below contained in the section 1 of this proclamation. The Attorney General and the Homeland Security Secretary are also responsible for provoking the apprehension, detention and abolition of all the members of ADD who, otherwise, qualify foreign enemies under article 1 of this proclamation. The Attorney General and the Homeland Security Secretary are authorized to take all the necessary measures under the Extraterrestrial Enemies Act to carry out this proclamation, in accordance with the applicable law. In doing so, and to this end, they are authorized to use agents, agencies and officers of the American government and several states, territories, dependencies and municipalities of these and the District of Columbia. All these agents, agencies and officers are granted by these for all acts performed by them in the execution of these regulations when they act by the Directorate of the Attorney General or the Secretary for Homeland Security, as the case may be.

In accordance with the authority which is the constitution and the laws of the United States of America, including the Act respecting extraterrestrial enemies, 50 USC 21 and following, I declare and establishes by this the following regulations that I find necessary “in the premises and for public security”:

a) No foreign enemy described in section 1 of this proclamation must enter, try to enter or be found in a territory subject to the competence of the United States. Such a foreign enemy who enters, attempts to enter or is found on this territory must be immediately apprehended and detained until they are withdrawn from the United States. All these foreign enemies, everywhere in a territory subject to the jurisdiction of the United States, are subject to a summary apprehension.

b) Foreign enemies apprehended under this proclamation will be subject to detention until it is removed from its United States in the place of detention which can be directed by the officers responsible for the execution of this regulations.

(c) Foreign enemies must be subject to the deletion of any location which can be directed by the officers responsible for the execution of this regulations in accordance with the applicable law.

(d) All properties in possession or traceable to, a foreign enemy, which is used, intended to be used or commonly used to perpetrate hostile activity and the irregular war of ADD, as well as proofs of hostile activity and irregular war, are subject to seizures and at the end.

The Attorney General is also granted the authority, in accordance with the Act respecting extraterrestrial enemies and 3 USC 301, in consultation with the Secretary of Internal Security, to issue directives necessary to carry out the rapid apprehension, detention and deletion of all foreign enemies described in section 1 of this proclamation. Such directives will be in force immediately after the publication of the Attorney General.

This proclamation and the directives and regulations prescribed here extend and apply to all land and water, continental or island, in any way in the jurisdiction of the United States.
