JAKARTA, KOMPAS.com – South Jakarta District Court Single Judge I Ketut Darpawan granted part of the pre-trial motion submitted by Roy Suryo regarding the alleged fake diploma of the 7th President of the Republic of Indonesia Joko Widodo (Jokowi).
The decision read Tuesday (7/7/2026) did not grant all of Roy’s lawsuits.
The judge only accepted certain requests relating to arrests, searches and detentions carried out by investigators.
So what is the reason why the judge only granted part of the pre-trial requests?

The arrest and search are considered formally flawed
In his considerations, the judge considered that the investigators did not have sufficiently solid reasons to immediately apply coercive measures against him. Roy Suryo.
According to the judge, Roy showed no intention of fleeing, destroying evidence or obstructing the investigation.
Apart from that, Roy was considered cooperative as he still fulfills the mandatory reporting obligations set by investigators.
Under these conditions, the judge considered that investigators should first use an official summons mechanism before making an arrest.
On this basis, the judge declared that the arrest and search action against Roy contained procedural defects and was therefore legally invalid.

Detention considered ineligible
The judge also granted Roy’s request regarding the legality of the detention.
The consideration is that the subjective conditions of detention were not found to be met because Roy was cooperative during the investigation.
This attitude shows that there is no fear that Roy will run away, destroy evidence, or repeat his actions.
For this reason, the judge declared Roy’s detention invalid.

Why are other applications rejected?
Although he granted some requests, the judge rejected a number of other points raised during pre-trial proceedings.
The requests that were not accepted included, among other things, the transfer of cases or Phase II from investigators to the Prosecutor’s Office, as well as the process of the case that was ongoing until it reached the South Jakarta District Court.
