Belly Mujinga’s family calls on police to release names of suspects who spat

The family of a railway worker who died with Covid-19 after allegedly being spat on have called on the police to release the suspect’s name.

Belly Mujinga, 47, died on April 5 last year from coronavirus after she was reportedly coughed and spat a few days earlier by a white customer at Victoria Station in London.

British Transport Police (BTP) questioned a 57-year-old man about the incident, but said there was insufficient evidence that a crime had taken place.

A lawyer for Ms Mujinga’s family, Lawrence Davies, said the force refused to release the suspect’s name, preventing them from pursuing private and other civil suits.

Speaking on the anniversary of the college graduate’s death on Monday, Davies told the PA News Agency: “We are pushing for two things, an investigation and the name of the man who (allegedly) assaulted her.

“But the BTP will not give the name. They have blocked me since September, so the family complained to the IOPC Fund (Independent Office for Police Conduct). “

Mr Davies said the family were looking for the suspect’s name in order to consider prosecuting him for harassment and assault.

They are also considering civil action against Ms Mujinga’s employer, Govia Thameslink Railway, he added.

BTP said it must take into account the “safety and security” of the person involved, as well as the data protection law which restricts the sharing of personal data collected as part of a criminal investigation.

A spokesperson for the BTP said: “Therefore, and in accordance with national police guidelines, we will only release a person’s name in the public domain if and when criminal charges have been brought against them.

“In this case, after examination of the evidence, bail interview and subsequent review by the Crown Prosecution Service, no further action was taken against them.”

The force said it was “not within the purview” of the police to assist the public in their pursuit of “civil remedies.”
